밀항단속법에 관한 연구

A Study on the Stowaways Control Act

전세계가 지구촌화되면서 국가간 빈부격차가 커지면서 밀항자들이 증가하고 있다. 사람들은 사회적 여건에 따라 북아프리카에서 유럽, 멕시코에서 미국 등지로 밀항을 하고 있다. 우리나라에서는 중국인, 동남아인 등이 국내로 밀입국하는 사례가 많지만, 국내의 살인 등 강력범, 중대경제범죄자, 간첩 등이 중국이나 일본 으로 밀항하는 예도 많다. 현행「밀항단속법」은 5·16 군사정변으로 집권한 군부에서 당시의 시대적 상황을 배경으로 주민통제와 국가안보를 강화하고자 제정하였다. 사회경제적 환경의 변화에 따라 「밀항단속법」도 개선되어야 할 것으로 생각된다. 1960년대에 비해 정치·제도적으로 고도로 발달된 현재의 상황에 있어서는 「밀항단속법」을 별도의 법률로 규정하기보다「출입국관리법」으로 불법출입국 문제를 일원화하여 미비한 점은 보완·발전시켜 나가는 것이 시대적 상황에 부응할 것이라 생각된다. 또한 해양경찰기관에 첨단보안장비·시설을 확충하여 21세기 세계화 시대에 맞는 종합적인 공항만 보안시스템으로 밀항을 예방하는 것이 필요하다.

As the world becomes globalized, smuggling is increasing as the gap between the rich and the poor nation grows. People are stowing away from North Africa to Europe, Mexico to the United States and elsewhere, depending on social conditions. In Korea, there are many cases of Chinese and Southeast Asians smuggling into Korea, but there are many cases of violent criminals such as murder, serious economic criminals, and spies smuggling into China or Japan. There is no article yet that has studied the Stowaway Control Act as a special criminal law that regulates stowaways. This study will comprehensively review the meaning and history of stowaway or illegal entry, and analyze the major precedents of stowaway, and discuss the improvement of the stowaway control act, focusing on the relationship between the stowaway control act and the immigration act.
