안티 포렌식 신종기법에 대한 형사법적 대응방안

A Study on the Understanding of New Anti-Forensics and Proposal of Criminal Policy Countermeasures

고도로 정보화된 현대 사회에서 디지털 증거의 중요성은 날로 증가하고 있으며, 그에 따라 디지털 증거를 분석하는 디지털 포렌식 기술이 발전하였다. 반면 디지털 포렌식에 대응하기 위한 안티 포렌식 기술도 함께 발전하였고, 여러 언론 기사에 회자 되면서 대중의 이해가 높아졌다. 이는 곧 수사의 혼선을 주고 증거인멸을 하는 안티 포렌식 기술의 활용으로 이어졌고, 안티 포렌식 기법의 난관을 극복하는 것은 지능 정보사회의 범죄수사에 있어서 매우 중요한 문제로 부상되었다. 하지만 안티 포렌식 기법은 외부적으로 잘 드러나지 않고, 정보보호 차원의 행위와도 구분이 어려운 특성이 있으며, 새롭게 등장하는 최신 기술 및 기기들에 대하여 즉각 대응하는 것 또한 반드시 용이하지만은 않기 때문에 안티 포렌식을 활용한 수사의 방해나 장애에 대응하는 것이 힘든 것도 사실이다. 전통적 안티 포렌식 행위는 그간의 연구를 통해 탐지 도구가 개발되는 등 어느 정도 대응이 가능해졌다고 한다면, 신종 유형의 안티 포렌식에 대해서는 아직 형사(법)적으로 대처가 까다롭고 어려운 것이 현실이다. 여기서는 안티 포렌식을 유형화하면서 특히 신종 안티 포렌식의 구체적인 사례 분석을 통해 제대로 이해하고, 이를 바탕으로 안티 포렌식의 형사정책적 대응방안을 기술적, 법제도적인 측면에서 제안하고자 하였다. 앞으로도 정보과학기술의 발전에 따라 다방면의 변종, 신종 안티 포렌식은 필연적으로 등장할 것이며, 이를 극복하기 위해서도 안티 포렌식에 대한 충분한 이해를 토대로 한 형사적 대응방안의 연구가 필요할 것이다.

In today s highly informative society, the importance of digital evidence is increasing day by day, and accordingly, digital forensic technology that analyzes digital evidence has developed. On the other hand, anti-forensics technology to respond to digital forensics has also developed, and public’s understanding has been raised as it has been talked about in various media articles. This led to the use of anti-forensics technology to confuse the investigation and destroy evidence. And overcoming the difficulties of anti-forensics has become a very important issue in criminal investigations. However, it is difficult to respond to anti-forensics because it has a characteristic that is not visible on the outside, and it is difficult to distinguish it from the act of information protection, also it is not easy to respond immediately to the latest technologies and latest devices that are pouring out every time. If traditional anti-forensics behavior was able to respond some degree, such as the development of detection tools through many studies, the new anti-forensics is a more difficult to respond. This study newly defined anti-forensics, and understood them through specific case analysis of new anti-forensics, and based on this, proposed the countermeasure of anti-forensics in terms of technical and legal aspects. In the future, various varieties and new anti-forensics will inevitably appear according to the development of technology, and in order to overcome this, it is necessary to study countermeasures based on sufficient understanding of anti-forensics
