수도회의 ‘형제적 공동생활’·‘카리스마와 세습자산’·‘사도직’에 관한 교회 문헌과 교회법적 체계 안에서 상호관계

‘Brotherly Community Life’, ‘Charisma(Patrimony)’ and ‘Apostolate’; Interrelationships Considered from the Context of Church Documents and Canon Law

본고는 공동체 안에서 ‘형제적 공동생활’과 ‘카리스마(세습자산)’, ‘사도직’에 관하여 그 상호관계를 교회 문헌과 법체계 안에서 조명하고 각 주제를 상호 연관성 차원에서 고찰하였다. 무관하게 분리되어 존재하는 법 조항들을 이 세 가지 개별 주제로 나누어 이해를 도모하는 동시에 이들의 상관관계를 조명함으로써 독립된 개념들 사이로 가교역할을 하는 상호 협력의 연결고리를 찾아낼 수 있을 것으로 기대하였다. 이에 필자는 첫째로 ‘형제적 공동생활’의 기본 개념과 이를 안정적으로 유지하기 위해 마련된 관련 교회법 조항들을, 둘째로 수도생활에 관련된 다양한 종류의 카리스마(세습자산)의 개념을 정리하고 교회법 안에서 이에 상응하여 대체된 용어인 ‘세습자산’을, 셋째로 위 두 주제와 연관된 ‘사도직’의 기본 개념과 이해를 다루었다. 이후 이 세 가지 주제에 대한 이해를 바탕으로 각 주제 간의 상호관계를 부각하고 이렇게 드러난 관련성에 따라 법 조항들의 연관된 체계를 구성해보았다. 이 작업은 표면적으로 서로 다른 세 주제가 궁극적으로는 선순환 관계로 통합된 일치를 구축하고 있음을 명시하는 효과를 목표하고 있다. 이러한 흐름에 따라 필자는 본고를 통해 흩어져 배치된 교회법 조항들을 세 주제의 같은 구도 안에서 연결하고 종합할 수 있는 개괄적 안목을 제공하여 각 조항의 보다 깊은 이해와 확대될 수 있는 적용의 폭을 시사하였다. 그러나 세 주제와 관련된 법 조항 각각의 내용을 분석하고 구체적으로 연결 짓는 작업은 본고의 범위를 넘어선다.

This article considers the interrelationships among ‘brotherly community life’, ‘charisma(patrimony)’ and ‘apostolate’ in the context of church documents and canon law. To gain a better understanding of these three topics this study takes a three-part approach. First, each are examined individually. Second, the study looks at how they are correlated, and how they work together to illumine mutual understanding. Third, this study explicates the concept of ‘brotherly community life’ within the supporting canonical provisions. The study locates the canonical term of ‘patrimony’ and how this concept later allowed for the substitution of various ‘charismas’ and defined their relation to religious life. Subsequently, the study surveys the basic idea of ‘apostolate’ and its connections to the concepts previously examined. Finally, the remodeled legal system is presented wtihin a new understanding of the themes’ mutuality. This process demonstrates agreement among three seemingly different themes which are in fact united within a virtuous circulation. In this stream of the text, scattered canonical provisions are assembled into the same structure, providing a deeper understanding of each law, and illuminating the range of the subject’s application. Linking the contents of each legal provision to an in-depth analysis, however, is beyond the scope of this study.
