의회 의사규칙과 의원법안 발의

Standing Orders and the Introduction of Private Bills: A Cross-National Analysis in Thirty-One Democracies

본 연구는 31개 민주국가에 대한 교차분석을 수행하여 의사규칙상 의회의원의 입법활동을 제한하는 요인의 수에 영향을 미치는 의회의 환경 내지 특성은 무엇이며, 이같은 의사규칙상의 특징이 의회의원의 법안 발의에 어떤 영향을 미치는 가를 경험적으로 고찰하고 있다. 그리고 연구결과를 토대로 의회의 의사규칙이 의회의 환경과 특성을 고려하여 효율성 제고의 관점에서 이루어졌다고 볼 수 있는가의 여부와 의회의원의 입법활동을 실질적으로 제한하는 요인으로 작용하는가의 여부에 대한 다양한 논의를 전개하고 있다. 뿐만 아니라 본 연구는 의회의원의 입법활동을 제한하는 의사규칙은 어떠한 상황들을 고려하여 제정될 때 당위성을 가지며 효과를 거둘 수 있는지에 대한 함의도 제공하고 있다.

The purpose of this research is to answer empirically the following two questions regarding Standing Orders of legislative body. First, why does the level of restriction set by Standing Orders of legislative bodies differ from democracies to democracies? Second, does the level of restriction set by Standing Orders of legislative bodies have impacts on legislators decision to introduce their private bills? In order to answer these questions, this research employs a cross-national analysis on thirty-one democracies. This study proposes various implications about institutional reforms regarding Standing Orders of legislative bodies with special emphases on institutional efficiency and democratic justice that the reforms intend to achieve.
