일선복지공무원의 재량행위(裁量行爲)에 관한 주요 이론적 쟁점 토의

Theoretical Discussions on the Controversial Issues around the Discretionary Acts of Street-level Welfare Bureaucrats

일선복지공무원은 복지행정의 고객들과 직접 접촉하는 지점에서 업무를 수행하면서 불가피하게 재량행위를 하고 있다. 물론 이들의 재량행위는 일선복지행정의 융통성, 적시성, 반응성을 제고하는 데 기여하지만, 자칫 오남용 될 개연성도 크다. 이렇게 되면 복지서비스의 형평성, 객관성, 신뢰성이 저하된다. 따라서 재량행위는 적절하게 관리되어야 한다. 이에 따라서 현재 일선복지공무원의 재량행위를 분석하기 위한 다양한 실증연구가 행해지고 있다. 그러나 여전히 확고한 이론체계나 분석틀에 대한 구축이 부실하여 재량행위에 대한 인식조사에 그치는 경우가 많다. 따라서 실증조사를 행하기 이전에 재량행위에 대한 보다 진지한 이론적 토의가 선행될 필요가 있다. 이러한 배경 하에서, 본 연구의 목적은 일선복지공무원이 서비스전달과정에서 행사하는 재량행위의 개념, 기능, 수준, 영향요인을 둘러싼 이론적 쟁점들을 토의하고자 하는 것이다. 따라서 본 연구는 이론 지향적 연구로서, 일선복지행정의 사례를 들어 이론의 적용도 부분적으로 행하지만, 이는 어디까지나 보조적인 것이다. 이러한 연구목적을 달성하기 위하여 본 연구는 주로 문헌연구의 방식에 의존하되, 다음과 같은 절차를 따른다. 첫째, 상기한 이론적 쟁점들과 관련하여 선행연구들에서는 어떠한 주장을 하고 있는가? 둘째, 상기한 이론적 쟁점들과 관련한 선행연구들에서의 주장들이 어떠한 한계가 있는가? 셋째, 상기한 이론적 쟁점들과 관련하여 본 연구가 제시하는 이론적 틀은 무엇인가? 그리고 이러한 토의를 행하는 과정에서 일선 복지행정의 실제에 대한 논의가 필요한 경우에는 주로 기초생활수급자 선정과정을 예로 들고 있다.

The purpose of this article is to debate on the controversial issues relating to the concepts, function, level, and causes of street-level welfare bureaucrats discretionary acts. In this regard, this article is basically theory-oriented one. Thus, while this article tries to apply theory in part, it stops at the auxiliary use. The following three are the key questions that this article intends to answer: What are the allegations in precedent studies with regard to the controversial issues around the discretionary acts of street-level bureaucrats? What the limitations of precedent studies in their allegations? What are the theoretical framework that this article suggests relating to the controversial issues of discretionary acts? When the discussions on the actuality of street-level welfare administration are needed in the process of debating over the discretionary acts of welfare bureaucrats, this article exemplifies the recipients selection process of the Basic Livelihood Security program.
