군사경찰 수사제도 문화의 문제점과 개선방안에 관한 사례 연구

Case Study on Problems of Military Police s Investigation System Culture and Improvement Measures

본 연구의 목적은 군사경찰의 수사제도 문화를 고찰해 봄으로써 군사경찰이 수사기관으로서최적의 실효성을 확보하기 위한 법령 등의 재정비에 필요한 시사점을 도출하는 것이다. 이를 위하여 군 수사관이 경험하는 수사 현실과 군 수사의 어려움에 대한 사례연구를 통해 살펴보고, 이에대한 개선 요소를 도출하였다. 본 연구를 통해 살펴본 주요 결과는 다음과 같다. 우선, 군사법원법의 문제, 군 내부의 문제, 수사관과 관련한 군 수사의 현실과 어려움을 발견할 수 있었다. 이와같은 연구결과를 근간으로 한 제언은 첫째, 군사법원법에 따른 범죄통계원표의 작성과 표준화둘째, 군사법원법에 따른 수사기준의 마련과 표준화 셋째, 군사법원법에 따른 수사지침서의 마련과 표준화가 필요함을 제시하였다. 그리고 군 내부의 문제와 관련한 결론과 시사점은 첫째, 군내부의 군사경찰에 대한 인식개선 노력과 실행 둘째, 군의 수사권문제 개선 셋째, 특정 범죄와중범죄에 대한 상설수사조직의 설립과 운영이 필요함을 제시하였다. 마지막으로 수사관과 관련한결론과 시사점을 살펴보면, 첫째, 군 수사관에 대한 교육과 연수제도의 개선 둘째, 군 수사관에대한 해외연수의 재개 셋째, 군 수사관의 연수 및 교육 점수의 진급 반영제도의 개선이 필요함을제시하였다.

This study is to derive implications necessary for the reorganization of laws and regulations to ensure optimal effectiveness of the military police as an investigation agency by examining the culture of the military investigation system. To this end, the investigation reality and the difficulties of military investigations experienced by military investigators were examined through case studies, and improvement factors were derived. The main results examined through this study are as follows. First of all, it was possible to discover the problems of the Military Court Act, internal military problems, and the reality and difficulties of military investigations related to investigators. Proposals based on these findings are: First, preparation and standardization of criminal statistics table according to the Military Court Act, second, preparation and standardization of investigation standards according to the Military Court Act, third, preparation and standardization of investigation guidelines according to the Military Court Act. Suggested that it is necessary. And conclusions and implications related to internal military issues are: First, efforts to improve awareness of the military police within the military and execution, second, improvement of the military s right to investigate, and third, establishment and operation of a permanent investigation organization for specific crimes and serious crimes is necessary.
