특가법 어린이보호구역치사상에 관한 판결분석과 교통조사 실무대응

An Analysis of Judgments based on the Min-Sik Law under the Act on the Aggravated Punishment, Etc. of Specific Crimes and Practical Countermeasures for Traffic Investigations - With a focus on judgments of lower instances sentenced for a year since the enforcement of the Min-Sik Law -

특정범죄 가중처벌 등에 관한 법률 제5조의13에 규정된 어린이보호구역치사상이 시행된 지 어느덧 1년이 지났다. 입법 초기이므로 현재까지 이와 관련된 대법원 판례나 헌법재판소 결정이 존재하지 않아 심도 있는 법리적 논의를 찾아보기 어렵다. 어린이보호구역치사상은 다른 법률과 비교하면 중형이 선고되므로 엄밀하고도 적확한 법적용이 필요하다. 그러나 현장 실무가들에게 참고될 수 있는 법적용 실태자료와 법리에 기반한 실무지침 등 기초자료가 미흡한 실정이다. 본 논문의 목적은 어린이보호구역치사상으로 의율되어 처벌된 하급심 판결서를 분석하여 일정한 경향성을 드러내고, 나름의 법적 의미를 도출하는 것에 있다. 또 교통조사 업무를 수행하는 수사실무가들에게 실무노트로서 기능을 하기 위함이다. 본 논문에서는 어린이보호구역치사상으로 의율되어 처벌된 하급심 판결들을 선별한 후, 귀납적 방법으로 분석하여 교집합과 합집합을 명확히 하여 법집행 실무에서 참고될 수 있는 시사점들을 도출하였다. 그런 다음 교통조사 실무가들을 위한 대응방안을 모색하였다.

It has been a year since the Min-Sik law, regarding injury or death of children resulting from negligence in Article 5-13 of the Act on the Aggravated Punishment, Etc. of Specific Crimes, came into effect. There isn t any precedent of concerned cases from the Supreme Court or decisions from the Constitutional Court since it is still in the early days of legislation, which makes it difficult to find in-depth judicial discussions about them. The Min-Sik Law imposes a severe sentence compared to other laws, thus requiring strict and accurate applications. There is, however, a lack of basic data, including actual data, about its application and practical guidelines based on legal principles that field practitioners can consult. Thus, this study set out to analyze written judgments of lower instances in which the accused were punished according to the application of the Min-Sik Law, displaying certain tendencies and identifying some legal significance. It also aimed to provide investigation practitioners looking into traffic accidents with materials for practical notes. After selecting judgments of lower instances in which the accused were punished according to the application of the Min-Sik Law, the study made an inductive analysis, clearly identified intersections and unions, and found implications that could be consulted in the practice of law enforcement. Based on them, the study searched for countermeasures for practitioners in traffic investigations.
