선원의 노동 및 인권교육을 위한 입법론적 연구

A Legislative Study on the Education for Labour and Human Right of Seafarers

선원들은 장기승선으로 인한 가족․사회와의 단절과 선상에서 벌어지는 각 종 인권침해로 인하여 승선 기피현상이 증가하고 있는 반면, 육상에서는 인권에 대한 관심이 높아지고, 일과 개인의 삶의 균형을 중시하는 분위기로 인해 선원들의 삶의 질에 대한 관심도 증가하고 있다. 이러한 선원 노동의 가치와 인권보호에 대한 담론 형성 및 문제의 제기가 됨에 따라 선원의 인권보호 및 이를 위한 정책적 시스템 마련이 시급하다. 이 논문에서는 선원직업이 갖는 특성과 함께 선원노동의 가치 및 인권보호의 당위성에 대해서 살펴본 후, 선원의 노동인권 실태조사에 따른 시사점을 바탕으로 우리나라가 갖추어야 할 선원노동인권 보호를 위한 제도로써 선원노동인권교육 시행을 위한 입법론적 제안을 하고자 한다.

Seafarers are increasingly avoiding boarding due to the disconnection from their families and society due to long period seagoing service, and various types of human rights violations on board. However Onshore, interest in human rights is increasing, and due to an atmosphere that emphasizes the balance of work and life, the interest in the quality of life of seafarer is also increasing. As discourses and issues are raised on the value of seafarers labor and protection of human rights, it is urgent to protect seafarers human rights and to prepare a policy system for this. In this paper, after examining the characteristics of the seafarer s profession, the value of seafarer s labor, and the justification of human rights protection, based on the implications of the survey on the labor rights of seafarers, it is a system for the protection of seafarer labor rights that Korea should have. I would like to a legislative proposal for the implementation of human rights education.
