The Impact of WTO/SPS Article 5.6 on Trade Liberalization Focused on Analysing SPS Dispute Cases

본 연구는 위생 및 식물위생조치를 채택하는 WTO회원국의 규제자치권이 무역자유화에 미치는 영향과 WTO/SPS분쟁에서 최근 인용되기 시작한 SPS협정 제5.6조와의 관련성을 살펴보고 있다. SPS협정 제5.6조는 “해당 조치가 회원국의 보호의 적정 수준을 달성하는데 필요한 정도 이상의 무역제한적인 조치가 되지 않도록 보장해야 한다”고 규정하고 있다. 이는 제2.2조의 필요성 테스트 그리고 제2.3조의 위장된 제한 금지와는 별개로, SPS 제5.6조에 명시된 3가지 요건을 충족시키는 형태로 적용되어야하므로 무역효과를 상쇄하는 수단으로 작용할 수 있다. 특히, 2012년 이후 SPS 관련 모든 분쟁에서 제5.6조가 인용되었고, 분쟁해결기구가 해당 조항을 인용한 사례들에서 세 가지의 요건을 적용함으로써 해당 조항의 해석에 관한 법리적 발전과정을 공고히 하였다. 이에 해당 논문에서는 WTO/SPS 분쟁에서 제5.6조를 적용한 사례들의 내용을 분석함으로써 무역자유화에 미치는 영향을 살펴보았다. WTO/SPS분쟁 관련 협의 요청된 가장 최근 사례(2021)에서도 제5.6조가 인용됨에 따라 해당 조항의 중요성은 시간이 지남에 따라 더욱 증가함을 알 수 있고, 이것은 WTO회원국의 과도한 무역제한성 및 WTO회원국의 국내 SPS조치에 상당히 잠재적인 도전으로 간주될 것이다.

This study examines the effects of WTO members autonomy and trade liberalization by taking Sanitary and Phytosanitary measures by the members, and the relevance of Article 5.6 of the SPS Agreement in resolving SPS disputes. Article 5.6 of the SPS Agreement stipulates that “Members shall ensure that such measures are not more trade-restrictive than required to achieve their appropriate level of sanitary or phytosanitary protection, taking into account technical and economic feasibility.” This is an independent obligation separate from the necessity test in Article 2.2, and the protection of the autonomy of the members regulated in Article 5.6 of SPS may apply a distinct form of trade-off means as an excessivity test. Therefore, the paper analyzes the content of all SPS disputes that apply to Article 5.6. In particular, from the examples cited in Article 5.6 from the SPS disputes, it examines the application of the three cumulative conditions of the dispute settlement body for Article 5.6 and the process of legal development of the applicable regulations through the results. Article 5.6 in the SPS dispute cases can be seen as a significant potential challenge to the domestic SPS measures of excessively trade-restrictive WTO members.
