中国电子诉讼的实践和认识

The Supreme People’s Court in China considers electronic Litigation as a major task of judicial development in order to ensure efficient case management and uniformity of judicial affairs, and strengthen the court’s responsibility. In order to do this, not only does it provide information on litigation information regarding the open access to the trial information and proceedings, but also some online litigation is being conducted in the district court. However, since the legal basis of electronic lawsuits is weak and electronic lawsuits are still in its infancy, the balance between the completion of the legal system and the use of electronic information technology should be solved. On the other hand, since the electronic litigation system in Korea is advanced in terms of its theoretical basics and practice, its reference will contribute to the development of electronic litigation schemes in China.
