난민인정 절차의 실태와 개선방안

오늘날 국제사회는 국가간ㆍ집단간 과거 전통적인 요인에 의한 분쟁보다는 지역적ㆍ지엽적인 다양한 요인에 의해 갈등을 겪고 있으며, 국가를 중심으로 한 자국민 보호의 개념이 상대적으로 미약해지고 있다. 이에 정치적ㆍ종교적ㆍ인종적ㆍ문화적 갈등 등 다양한 요인에 의해 발생하는 수 많은 분쟁들은 그 구성원 역시 영토적 주권을 포기하고 국제사회로 난민의 형태로 급박하게 이동하는 현상으로 나타나고 있다. 그럼에도 불구하고, 국제 난민에 대해 대부분의 국가에서는 기존의 국가와 국경을 원인으로 하는 단순한 물리적 차단이나 방어보다는 인도적 차원에서의 난민 관리에 적극적인 난민보호정책을 실시하고 있다. 이에 국내에서는 난민 문제 해결과 관련하여 난민인정절차에 있어서 먼저, 국제기준에 부합하는 새로운 난민 개념을 적용해야 하고, 새로운 이의신청 심의기구인 난민심판원 제도를 도입하며, 난민신청자의 절차적 권리보장 강화를 할 필요가 있다. 이와 관련하여 난민법에 열거된 난민 정의 규정을 개정하고, 국내 법원이 관행상 난민의 정의를 광의로 해석해야 한다. 또한 국제기준에 부합하기 위하여 UNHCR 난민편람, 지역협약, 주요 선진 국가의 난민인정범위 등을 참고하여야 한다. 마지막으로 출입국항에서 이동의 자유, 변호인의 조력을 받을 권리 등의 기본적 권리보장, 난민전문통역인 제도를 보완해야 한다.

In today s international society, disputes arise from a variety of factors, such as political, religious, racial, and cultural conflicts, rather than those caused by traditional factors between countries and groups, and the concept of protecting the people is becoming relatively weak. Numerous refugees have given up their territorial sovereignty and are rapidly moving from the international community to refugees. Active administration is being carried out. In Korea, the refugee recognition process needs to be improved to resolve the refugee problem. First, a new concept of refugee that meets international standards must be applied, strengthening the procedural rights of refugee applicants, and introducing a new objection review body, the refugee trial system. In addition, the refugee definition regulations should be revised under the Refugee Act, and domestic courts should interpret the definition of refugee in a broad sense. Lastly, it is necessary to refer to the scope of refugee recognition, to guarantee basic rights such as freedom of movement at the port of entry and the right to receive assistance from lawyers, and to supplement the refugee interpreter system.
