외국인 피해자 보호・지원 실태와 입법・정책적 과제

Status and Tasks of Protection and Support for Foreign Victims

국내 체류 외국인은 2019년 말 현재 252만 명을 넘어, 전체 인구의 약 4.86%에 이르고 있다. 외국인 피해자에 관한 공식통계는 존재하지 않지만, 이미 가정폭력범죄 중 다문화가정의 비율이 전체의 약 3.04%에 이르고 있는 등 외국인 피해자의 비율은 상당수에 이를 것으로 추정된다. 그런데 외국인은 문화적, 언어적 특성으로 인하여 피해 신고가 쉽지 않은 등 범죄피해자 지원제도에 대한 접근성이 떨어져 내국인과 동일한 수준의 보호・지원을 받기 어려운 환경에 놓여 있다. 실제로 2019년 전국 범죄피해자지원센터에서 지원한 외국인 피해자의 비율은 전체 인구대비 외국인 수에 훨씬 못 미치는 1.3%에 불과하여 많은 외국인 피해자가 지원의 사각지대에 놓여 있음을 추정할 수 있다. 이에 본고에서는 먼저, 외국인 피해자의 법적 지위와 지원의 당위성을 검토한 후에, 실무가를 대상으로 진행된 외국인 피해자 보호・지원 실태조사에 관하여 개관하였다. 이를 토대로 외국인 피해자의 보호・지원을 제고하기 위한 입법적・정책적 방안으로, 형사절차 참여권의 실효적 보장, 보호・지원의 틈새 해소, 기관간의 연계 등을 제시하였다.

The number of foreigners staying in Korea exceeded 2.52 million as of the end of 2019, accounting for about 4.86 percent of the total population. Official statistics on foreign victims do not exist, however the proportion of foreign victims is estimated to reach a considerable number, with the proportion of multicultural families among domestic violence crimes already reaching about 3.04 percent of the total. However, foreigners are in a difficult situation to receive the same level of protection and support as Koreans due to lack of access to the crime victim support system, as it is not easy to report damages due to cultural and linguistic characteristics. In fact, the ratio of foreign victims supported by crime victim support centers nationwide in 2019 is only 1.3 percent, far below the total number of foreigners compared to the total population, which can be estimated that many foreign victims are in the blind spot of support. Under such awareness of the problem, this study first reviews the legal status and justification of support for foreign victims and introduces the actual status of protection and support for foreign victims. Based on this, legislative and policy measures are proposed to enhance the protection and support of foreign victims, including the guarantee of the right to participate in criminal procedures, the resolution of gaps in protection and support, and the linkage between agencies.
