제4차 산업혁명과 사회국가 실현 등에 대한 전망과 과제

제4차 산업혁명시대라고 불리는 지금 인간이 아닌 자율적, 법적 주체로서 인공지능의 등장, 기술 융합형 인간의 출현 등으로 인해 전 세계적으로 큰 혼란이 초래될 것이다. 무엇보다 헌법적 관점에서 인공지능을 위시한 제4차 산업혁명기술들은 민주주의, 법치국가 등 헌법상의 일반원리는 물론, 사생활의 자유, 표현의 자유, 근로의 권리, 인간다운 생활을 할 권리 등 국민의 기본권을 자동적으로 보장해 주는 것이 아님을 명심할 필요가 있다. 이럴수록 우리는 새로운 기술에 대한 법적 쟁점을 면밀히 분석하여 우리 사회가 어떻게 변할지를 선제적으로 예상하여 그 대안을 마련해야 한다. 즉 기존 법규범 체계에 새로운 기술을 수용하는 과정에서 인간사회가 겪게 될 갈등과 불안에 대한 입법적 공백을 파악하고, 그에 맞는 올바른 규범체계를 정립해야 하는 것이다. 한편 이러한 법제도상의 대안 마련과 함께 선결되어야 하는 과제는 국민 모두가 인공지능 시대를 잘 맞이하도록 사회문화적 접근도 병행되어야 한다는 점이다. 마지막으로, 4차산업 혁명시대에서도 사회국가원리의 실현은 법치국가적 형식과 절차, 한계 내에서 이루어지지 않으면 안 된다. 법치주의가 무시되는 사회국가는 또 다른 형태의 전체주의국가로 전락할 위험이 있으며 개인의 개성과 자유가 제대로 보장되지 않는 생존은 인공지능이란 보이지 않는 새로운 절대권력에 예속된 나약한 생존으로 전락할 수도 있다. 그런 의미에서 4차 산업혁명이 고도화 될수록 헌법상 사회국가와 법치국가원리는 대립적 관계가 아니라 서로 상호 보완해 나가야 하는 관계임을 명심해야 하겠다.

As the 4th Industrial Revolution deepens, our society will become very confused by new phenomena that have not appeared until now, such as the emergence of another autonomous, legal subject other than humans, and the mergence of fusion-type humans that are fused with various technologies. The more so, we need to closely analyze the legal issues of new technologies and look closely at the consequences they will bring to predict how our society will change and to come up with legal alternatives accordingly. Above all, it is necessary to recognize that the technologies of the Fourth Industrial Revolution, including artificial intelligence, do not automatically guarantee democracy, a state of law, freedom of privacy, freedom of expression, the right to work, and the right to live a human life. Therefore, it is necessary to grasp the legislative gap in the conflict and anxiety that human society will experience in the process of accepting new technologies in the current constitution and legal norm system, and establish a new normative system accordingly. Along with the preparation of such an alternative legal system, a socio-cultural approach should also be paralleled so that all citizens can meet the age of artificial intelligence by providing people-friendly services related to artificial intelligence based on human-centered values. In addition, even in the era of the 4th industrial revolution, the realization of the social-state principle must be achieved within the form, procedure and limits of the rule of law. A social state in which the rule of law is ignored is in danger of falling into another form of totalitarian state, and the survival of individuals whose individuality and freedom are not properly guaranteed can be degraded to the survival of the invisible power of artificial intelligence. In that sense, it should be borne in mind that as the Fourth Industrial Revolution advances, the social state and the rule of law are not confrontational, but complement each other.
