안전관리계획의 실효성 제고 방안에 관한 연구

A Study on Effectiveness Improvement of Safety Management Plan

재난 등 긴급한 상황에서 신속하고 효율적인 대처를 위해 예방단계부터 대비, 대응, 복구단계에 이르기까지 단계별로 적절한 계획이 필요하다. 이를 위해 국가 차원에서의 국가안전관리기본계획은 중앙부처의 안전관리계획을 통합하여 『국가안전관리기본계획』을 수립하고 있고, 각 소관 법령에서해당 분야의 안전관리계획을 규정하고 있다. 본 연구는 개별 중앙행정기관이 소관 법령에 따라 규정하고 있는 안전관리계획을 분석하여 그 미비점과 개선방안을 도출하는 데에 그 목적이 있다. 총272개의 안전 관련 주요 법령 조사결과를 바탕으로 본 연구에서는 이러한 분석을 토대로 개선방안으로 첫째, 유사 안전 관련 법령 비교·분석을 통하여 체계적 안전관리계획 수립이 필요한 분야 발굴및 규정 신설, 둘째, 계획수립 시 절차적 정당성 확보를 위해 관계기관과 전문가, 국민 등을 대상으로사전의견 수렴하는 절차 의무화 규정 도입, 셋째, 외부공개 및 사후 평가 등 안전관리계획의 실효성확보를 위한 수립 후의 후속 조치 마련 등을 제시하였다.

In order to respond to emergency situations such as disasters, it is necessary to plan appropriately from the prevention stage to the preparation, response and recovery stages. The purpose of this study is to analyze the safety management plans stipulated by individual central administrative agencies in accordance with the relevant laws and regulations, and to derive the problems and improvement of the plans. As a result of the investigation of a total of 272 major safety-related laws and regulations, this study suggested improvement measures. First, through comparison and analysis of similar safety-related laws and regulations, new establishment of relevant safety management plan when necessary, second, relations to secure procedural justification when establishing a plan, and third, preparation of follow-up measures after establishment of the plan to secure the effectiveness of the safety management plan.
