산업안전보건법령의 산업안전기준에 관한 규칙 중 제3장 전기로 인한 위험방지를 타법령과 비교 분석

Regulations on Industrial Safety Standards of the Industrial Safety and Health Act Chapter 3 Comparison and Analysis of Prevention of Risk from Electricity with Other Laws

이 연구에서는 산업안전보건법령 중 안전보건기준에 관한 규칙의 전체 조항 중에서 제3장 전기로인한 위험방지를 전기시설을 시공하기 위한 기준인 전기설비기술기준 판단기준과 내선규정을 중심으로 비교하여 일부 서로 달리 적용하는 조항에 대하여 통일성을 가져야 시설을 한 번에 시공하여 사용하는 데 불편함이 없도록 해야 두 번, 세 번 시설을 보완하는 불편함이 없도록 해야 하지 않는가 하는 생각에 연구를 시작하였다. 안전보건기준에 관한 규칙은 1990년에 제정되어 산업현장의 안전보건기준으로 정착되면서 일부 조항들이 시대의 변화에 맞게 매년 개정되면서 전문가들과많은 사업장 안전관리자들 사이에서 많은 불만과 적용에 어려움을 느껴왔다. 유독 많은 조항들이 개정되면서도 제 3장 전기로인한 위험방지 부분만은 2017년 1차례 개정되었다. 이 항목은 비상전원에 관련된 사항으로 최근 배터리(리튬이온 배터리)가 추가된 것이다. 그간 한국의 전기산업이 글로벌화 되면서 국제규격과의 통일이 전기업계와 제품을 개발하고 생산하는 산업계, 그리고 학계에서 꾸준히 제기되고 통일을 위한 노력이 시행되어 오다가 2018년도 전기와 관련된 모든 규정이 통일된 KEC(한국전기설비기준)이 제정되어 2021년 1월부터 적용하게 되었다. 이는 그간 엄청난 노력을 기울인 결과라는 생각이 든다. 이에 맞게 안전보건기준에 관한 규칙도 보조를 맞추어 개정되어야 한다는 생각에 본 연구를 시작하게 되었다. 고용노동부와 안전보건공단의 기술제정위원회에서 본 사실을 염두에 두고 개정을 위한 노력이 실행되고 있다는 것을 염두에 볼 때, 부분적으로 불일치한 내용도 일치를 시켜야 한다고 생각한다.

In this study, we began to think that among all the provisions of the Rules on Safety and Health Standards, we should be consistent with the clauses that apply some different parts of the electric facility technology standard and the internal regulations, which are the criteria for the construction of electric facilities, so that there is no inconvenience in supplementing the facilities twice or three times. The rules on safety and health standards were established in 1990 and established as a safety and health standard for industrial sites, with some provisions being revised every year in line with the changing times, and have found it difficult to apply and complain among experts and many business safety managers. Despite the revision of many clauses, the risk prevention section of Chapter 3 was revised once in 2017. This item relates to emergency power, with the recent addition of a lithium-ion battery. As Korea s electricity industry became globalized, the Korean Electrotechnical Commission (KEC) was enacted in January 2021, where unification with international standards was steadily raised by the electric industry, the industry, and academia, and efforts for unification were made. I think this is the result of a lot of effort. Accordingly, the study was started with the idea that the rules on health and safety standards should also be revised in line with the same way. Given the fact that efforts are being made to revise the work force in mind that we have seen in the technical committee of the Ministry of Employment and Labor and the Health and Safety Corporation, I think that some discrepancies should be harmonized.
