화학사고 연구사례 교훈을 통한 위기관리 연구

A Study on the Risk Management through the Lessons of Chemical Accidents

본 연구는 화학 산업안전보건 및 화학생활안전에 영향을 미치는 법령 중 산업안전보건법, 화학물질관리법, 화학물질의 등록 및 평가 등에 관한 법률의 제정 목적을 달성하기 위한 법령의 명확한 기준과 과학적 근거에 의한 신뢰성 보증, 법 목적에 비례하여 국민의 기본권과 안전에 관한 보장문제를 해결함에 있어, 현행 산업안전보건법, 화학물질관리법의 운영 상 나타나는 일부 미비점에 대한 원인과 이에 대한 개선방안의 의견 제시를 목적으로 수행하였다. 연구의 대상은 사업장에서 화학물질을 저장 취급 사용하면서 일어날 수 있는 화학사고가 해당 사업장은 물론 인근 지역에까지 영향을 미치는 것에 관한사항과 그 시행에 필요한 사항을 위임한 산업안전보건법, 화학물질관리법에 관한 법규 중 화학물질안전에 대한 부문을 대상으로 하였으며, 연구의 방법은 관련 법령 및 문헌의 조사 및 검토, 화학물질누출사고로 직접적인 피해를 입은 지역민의 인터뷰 등으로 수행하였다. 연구 결과, 여러 가지 문제점이 돌출되었으며, 이중 관계발생빈도 및 강도가 높은 기인물을 대상으로 부적합 원인 및 개선방안에 대하여 연구를 수행하였으며, 대상이 되는 기인물은 ‘화학물질’로 하였다. 주요 문제점으로는 죄형법정주의에서 요구되는 명확성의 원칙이 보장되지 않는 것으로 인한 법 적용의 명확하지 못한 것으로 인한 혼선 초래와 소극적인 사업자의 의무 이행 정부관리 감독처인 고용노동부, 환경부, 행정안전부의 소극적인 관리감독과 국가의 책무에 대한 임무소홀 폐단과 국민의 준법에 대한 불신, 정보부족으로 인한 국민들의 무관심과 무지 등으로 분석되었으며, 이에 대한 개선방안으로 규칙은 명확성의 원칙에 의거 명확하게 정비될 필요가 있으며, 법제정 목적에 비례하여 국민의 최소한의 기본권 안전을 충족과 기술변천과 환경의 변화에 따른 변화를 충분히 이해하여 수용하고, 유관 기관 간 정보공유와 공동대응 그리고 사업자의 의무를 성실히 이행되는 환경과 관계 법률이 타 법과의 중복이 되지 않으면서 시스템적, 법률적, 기술적으로 해석과 신뢰성이 확보될 수 있도록 개정됨이 필요하다 사료된다.

This study clearly shows the purpose of enacting the Chemical Industry Safety and Health and Chemical Life Safety and Health Act among the statutes that affect construction safety. The purpose of the Act was to present opinions on the causes and improvement measures for certain shortcomings in the operation of the current Industrial Safety and Health Act, Chemical Management Act in solving problems such as guaranteeing reliability based on a standard and scientific basis and guaranteeing the people s minimum basic rights relative to the purpose of the Act. The subjects of the study were to be carried out in the Chemical life safety and Health Act, among the rules on the Industrial Safety and Chemical Safety and Health that were entrusted with the implementation of the Chemical Industry Safety and Health standards, and the research method was conducted by investigating and reviewing relevant statutes and literature and interviewing local citizens directly affected by chemical leakage accidents. Several problems were raised in the study, and nonconforming causes and improvements were carried out on double frequency and strength-induced objects, while the subjects were Chemical substance . The rules on Chemical Industrial Safety and Health standards are to be applied to the Industrial Safety and Health Standards delegated by the Act, and to the regulations required for their implementation. The rules stipulate that failure to comply with the rules is punishable by the penalties prescribed in the law. Therefore, it should be considered that the rules need to be clearly adjusted according to the principle of clarity, and revised to meet the smallest basic rights of the people, to fully accommodate changes over time, and to ensure engineering interpretation and reliability without conflicts with other laws.
