건설 하도급 계약에 있어 물가변동(ESC)적용의 문제점 분석 및 개선방안

Problem Analysis and Improvements for Applying Escalation in Sub-contracting

본 연구는 건설 하도급 계약에 있어 물가변동 적용의 문제점 분석 및 개선방안을 제시하는 것을 목적으로 수행되었다. 이를 위해서 실제 물가변동이 적용된 프로젝트 3곳을 사례로 선정하였다. 사례분석 및 전문가 면담조사를 통해 하도급 물가변동 적용의 문제점을 도출한다. 사례조사와 면담조사의 결과를 기반으로 하도급 물가변동 적용의 개선방안을 제시한다. 상기와 같은 연구 목적 및 방법에 따라 도출된 결과를 정리하면 다음과 같다. 1) 하도급 물가변동 적용의 문제점은 기 계약된 하도급의 물가변동 적용 기준의 불명확성, 물가변동 후 계약되는 하도급에 대한 물가변동 미반영, 하도급 물가변동 적용에 대한 감시체계 미흡, 원도급의 하도급 물가변동 적용에 대한 적정성 검증을 위한 기관 부재가 도출되었다. 2) 하도급 물가변동 적용에 대한 개선방안으로는 각 하도급별 물가변동 조정율 산출 방법을 통한 적용기준 통일, 물가변동을 반영한 하도급 공종별 변경내역서 작성으로 원도급의 물가변동 후 계약되는 하도급에도 물가변동이 반영, 담당 감독관 및 감리원의 임무강화로 감시체계 확립, 공신력 있는 원가계산 연구기관을 통한 적정성 검증 둥 을 제시하였다.

The purpose of this study is to analyze the problems of applying escalation and suggest how to solve the problems. For this study, The 3 projects that applied escalation are selected. The problems of applying escalation between general contractor and sub-contractor were suggested through the case study and experts interview. Base on the case study and experts interview, Improvements for applying escalation in sub-contracting were suggested. The results of this study are as follows: 1) The problems for applying escalation to sub-contractor are these. A uncertainty of a escalation standard for subcontractor who was contractual when happened a escalation for general contractor. No application for sub-contractor who was not contractual when happened a escalation for general contractor. Insufficiency in escalation surveillance system. Establishment absence for verifying appropriateness of escalation for sub-contractor. 2) Improvements for those problems are these. Standardizing a method for calculating escalation rate through application considered each details. Applying escalation to subcontractor who was not contractual when happened a escalation for general contractor through making detailed statement which reflected escalation. Establishment escalation surveillance system through reinforcement supervisor’s duty. Verifying appropriateness of escalation for sub-contractor through establishment which have public confidence.
