해방 이후 정윤환(鄭潤煥)의 주요활동과 발표논문에 관한 연구

A Study on the main roles and papers of Yun-Hwan Jung(鄭潤煥) after liberation

일본의 오랜 식민지배로부터 해방된 우리나라는 새로운 국가를 수립해야 하는 과제를 안게 되었다. 하지만 해방 당시에 헌법을 비롯한 개별법률을 제정할 인물이 부족한 형편이었다. 이러한 상황에서 당시 고등법원 판사였던 정윤환의 활동과 그가 남긴 글을 주목하지 않을 수 없다. 해방 이후 그의 주요한 활동으로는 첫째, 1947년 법전기초위원회 위원과 1948년 법전편찬위원회 위원으로 임명되었다. 둘째, 대한민국헌법초안 작성에 참여하였다. 셋째, 법원조직법초안을 작성하였다. 넷째, 미군정법령 제176호(형사소송법의 개정) 제정 등에 참여하였다. 해방 이후 정윤환은 헌법, 행정소송법, 형사법 등에 관하여 많은 글을 남기고 있다. 특히 헌법의 한 내용인 사법제도에 대하여 많은 글을 남기고 있다. 그가 남긴 헌법과 관련한 글은 헌법일반론, 기본권론, 사법제도론으로 나누어 살펴볼 수 있다. 이 중 사법제도론 분야에서 그는 첫째, 법원에 의한 위헌법률심사제도를 주장하고 있다. 둘째, 특별법원의 설치를 반대하고 있다. 셋째, 법관에 대한 탄핵재판을 반대하고 있다. 이상에서 살펴본 것처럼 해방 이후 정윤환은 새로운 국가를 수립하는데 필요한 헌법을 비롯한 법제정에 많은 활동을 하였다. 당시 김병로, 이인, 권승렬 등이 법조계 원로로서 중요한 역할을 하였다면, 정윤환은 유능한 실무가로서 실제 법기초에 많은 활동을 한 것으로 생각된다.

There were a lot of urgent matters in Korea after liberation. But there were little people to draft Acts as well as a Constitution then. In the circumstances, I can t help laying an eye on what Yun-Hwan Jung(鄭潤煥) who was a High Court judge did and wrote. After liberation, first, he was appointed as a committee of Code Drafting Commission(法典起草委員會) in 1947 and Code Drafting Commission(法典編纂委員會) in 1948 respectively. Second, he took part in drafting the Constitution. Third, he drafted Court Organization Act. Fourth, he took part in drafting the USAMGIK(United States Army Military Government in Korea) Ordinance No. 176(Changes in Criminal Procedure) and so on. After liberation, he wrote many papers about constitutional law, administrative litigation law, criminal law and so on. Especially, he wrote many papers about the judicial system. Papers about constitutional law can be divided into the general, fundamental rights, judicial system. In the judicial system, first, he insisted judicial review by the court. Second, he was against establishing special courts. Third, he was against impeachment trial about judge. As stated above, Yun-Hwan Jung took many roles about drafingt Acts as well as a Constitution needed to establish new country after liberation. If Byeong-Ro Kim, In Lee, Seung-Ryeol Gwon etc took important roles as doyens of legal profession, Yun-Hwan Jung took many roles in drafingt Acts as a competent man of affairs.
