공공조달에 있어서 경쟁정책과 중소기업보호정책의 조화에 관한 연구

A Study on Reconciliation between Competition Policy and Policy for Protecting Small and Medium Businesses in Public Procurement

공공부문에서의 조달은 경쟁정책과 중소기업보호정책의 조화를 통하여 이루어지고 있다. 이를 구체화한 제도로서 희망수량입찰제도가 운영되고 있으며, 동 제도 하에서 공급자의 조합은 핵심적인 역할을 수행한다. 적기공급‧품질관리 등이 매우 중요한 레미콘‧아스콘에서는 조합의 역할이 필수적인 산업이기 때문에 조합 중심의 입찰 및 공급시스템을 구축하되, 물량배정과 조합운영에 있어서 투명성과 공정성을 높이기 위해, 배정심의회나 감독위원회와 같은 독립 기구를 설치하는 방안이 효과적일 수 있다. 결국 조합 중심의 경쟁을 실질적으로 활성화하면서, 동시에 적시공급과 물량확보 및 하자관리 등에 있어서 조합의 기능을 제고하는 방안을 모색할 필요가 있다. 이때 조합의 역할은 중소기업보호정책이나 지역경제 기반 확충 등 산업정책적 관점에서도 의의가 있다. 원재료 비중이 높고 제품차별화의 여지가 거의 없는 레미콘·아스콘 시장의 특성상 조달과정에서 가격경쟁이 제대로 일어날 가능성은 매우 적다. 따라서 궁극적으로는 당해 시장에서의 사업자 간 경쟁을 가격경쟁에서 품질경쟁으로 유도하는 방안도 적극적으로 검토할 필요가 있으며, 낙찰자 선정 또한 최저가격에만 의존하기 보다는 품질이나 생산능력 등과 관련된 다양한 지표를 종합적으로 고려하여야 할 것이다.

Article 1 of “Act on Facilitation of Purchase of Small and Medium Enterprise-Manufactured Products and Support for Development of Their Markets” stipulates that the purpose of this Act is to contribute to the enhancement of the competitiveness of small and medium enterprises and to the management stability thereof by facilitating the purchase of small and medium enterprise-manufactured products and supporting the development of markets therefor. And Article 17 (2) of “Enforcement Decree of the Act on Contracts to Which the State is a Party” stipulates that in a general competitive tendering procedure for the manufacture or purchase of goods in a large quantity, a supplier may be allowed to make a tender with the quantity that he/she desires to supply and the unit price therefor within the maximum of the required quantity of goods. These provisions show that they are pursuing both competition policy and small-medium business protection policy at the same time and harmonization of the two policies. In particular, it could be understood that the desire quantity bidding system is a system that embodies the harmony of the two policies, and The system also applies to the Remicon and Ascon markets. However, in the markets of Remicon and Ascon, the system is causing problems, especially in terms of competitive policy. There is a need to find a way to activate the competition centered on cooperatives.
