미국 테러방지 체제상의 인권보호제도에 관한 일고찰

A Study on the Human Rights Protection System in the Anti-Terrorism System of U.S.A. - focusing on U.S. Department of Homeland Security

2001년 9월 세계를 놀라게 한 “9/11 테러사건(September 11 attacks)” 이후 많은 국가들이 나름의 테러대응체제를 마련하는데 주력하였지만, 2019년에도 세계 곳곳에서 크고 작은 테러로 인한 적지 않은 피해가 발생했다. 다만 이러한 테러 발생 양상을 좀 더 살펴보면 테러대응체제가 잘 갖추어진 국가들의 경우 비록 테러의 발생을 완전히 차단하기에 이르지는 못하였다 하더라도 상대적으로 적은 피해만을 입고 있는 것을 확인할 수 있다. 우리나라 역시 테러의 위협에서 완전히 자유롭다고는 할 수 없겠기에 테러대응체제가 잘 갖추어진 국가들을 참고하여 테러대응태세를 점검하는 것은 충분히 의미가 있을 것이다. 그렇지만 테러방지와 함께 인권보장 역시 포기할 수 없는 목표임에도 불구하고, 그 동안의 우리 학계의 테러 관련 논의는 상대적으로 경찰학계 및 보안학계를 중심으로 효과적인 테러방지 방안, 즉 테러방지의 효과성 내지 효율성을 높이기 위한 방안의 확보에 치중되어 있었다고 할 수 있겠기에, 효과적인 테러방지체제 구축과 함께 적절한 인권보장을 위한 기제에 대한 고찰이 더욱 필요한 시점이라 할 것이다. 이에 미국의 주요 테러방지법제와 함께 대표적인 테러방지 실행체제로서 국토안보부(Department of Homeland Security; DHS)의 목적과 조직 및 운영양상 그리고 국토안보부 내의 인권보호기제를 살펴 본 바, 미국은 테러의 방지를 주요한 정책과제로 설정하고 있으면서도 테러의 예방에 있어서 그 실질적인 운영양상은 국경 및 출입국 관리를 필두로 질서유지와 시설의 안전 관리 등의 통상적인 국가관리·운영 체제의 엄격한 실행을 통해 그 목적을 달성하려 하고 있음과 함께, 인권보장을 위한 시민권 및 시민의 자유국(The office for Civil Rights and Civil Liberties; CRCL)이 국토안보부 내의 존재감 있는 독립부서로 자리매김하고 있음을 확인할 수 있었다. 이는 우리나라의 테러방지체제의 운영, 특히 우리나라의 테러방지체제상의 인권보호 기제로 설정되어 있는 대테러인권보호관제도의 개선에 큰 참고가 될 만하다 하겠다.

Since the “September 11 attacks” which shocked the world in September 2001, many countries have made huge efforts to establish counter-terrorism system. But large and small terrorism caused a lot of damage around the world even in 2019. However, if we look more closely at these terrorism outbreaks, countries with well-established anti-terrorism system are suffering relatively little damage, even if they do not completely block the occurrence of terrorism. Korea cannot be said to be completely free from the threat of terrorism, so it would be meaningful to examine the anti-terrorism system in Korea with reference to countries with well-established anti-terrorism system such as U.S.A. Although human rights protection is just as important as prevention of terrorism, the discussions on terrorism in our academia have been focusing relatively the latter i.e. improving the effectiveness or efficiency of anti-terrorism. So it is right time to consider the mechanisms for the proper protection of human rights as well as the establishment of an effective terrorism prevention system. In this context, this study looked at the major anti-terrorism legislation of the United States, the purpose, organization and operation of the Department of Homeland Security(DHS) as a major anti-terrorism execution system of the United States, and human rights protection mechanisms within the DHS. While the United States sets terrorism prevention as a major policy task, the practical aspects of terrorism prevention are the strict implementation of normal state management and operating systems such as maintenance of order, including national border management and immigration control. And it was also confirmed that the Office for Civil Rights and Civil Liberties(CRCL) has established itself as an important department within the DHS for human rights protection. This can be a great reference for the operation of Korea s anti-terrorism system, especially for the improvement of the office for human rights protection in anti-terrorism established as a human rights protection mechanism of anti-terrorism system in Korea.
