좋은 규제의 판단기준에 관한 소고

A Study on the Judgement Criteria of Good Regulations

역대 정부의 각종 규제개혁 시도에도 불구하고 규제의 문제점이 지속적으로 제기되고 있음을 볼 때, 적절한 규제시스템을 만들고 그것을 효율적으로 작동시키는 것은 결코 쉽지 않은 정책과정임을 알 수 있다. 경제를 활성화하고 민생불편을 실질적으로 해소하는 규제개혁을 위해서는 ‘좋은 규제’의 개념에 대한 숙고가 선행되어야 하는 이유이기도 하다. ‘좋은 규제’는 우선 그 내용과 형식이 예측가능성과 명확성, 법률유보의 원리 등 법의 일반원리에 부합하여야 하고, 변동성이 심한 현대사회의 특성을 반영하여 중요성이 강조되고 있는 정보전달 합리화에 의한 리스크 관리, 소비자 보호수준의 제고 등 현대적 규제원리에 대한 이해를 필요로 한다. 아울러 최근 4차 산업혁명의 규제이슈 등을 감안하여 신기술․산업에 대한 사전허가의 활용과 자율규제의 확대도입 등 규제개혁을 위한 법 제도의 도입에 대한 다각적인 검토가 뒷받침되어야 한다. 다만, 현대적 규제원리나 법 제도를 도입할 경우 헌법상 법치국가의 원리에서 도출되는 규제의 일반원칙과 모순․저촉되는지 여부를 유의하여야 할 것이다. 현재 정부는 규제혁신 성과창출과 국민․기업의 체감도 제고라는 목표 아래 우선 허용-사후규제 방식으로 규제의 패러다임을 전환하는 등 규제정비를 국정과제로 추진하고 있다. 정부가 좋은 규제의 다양한 함의를 충분히 고려하고 이를 규제관리체계에 반영할 때, 단순한 규제철폐나 규제완화가 아닌 규제의 품질을 제고하는 합리적인 규제개혁이 이루어질 것이다.

Despite the continued attempts to reform regulations, the regulatory problems remain unresolved. Creating a proper regulatory system and working it efficiently will never be an easy policy process. However, it also calls attention to the need to think about the concept of good regulation first in order to revitalize the economy and effectively solve life’s problems. Good regulations first require understanding of modern regulatory principles, such as predictability, clarity, and the principle of legal guidance, and the rationalization of information transmission in which importance is emphasized by reflecting the characteristics of modern society. In addition, various reviews on the introduction of the legal system, including the use of prior permits and the introduction of expanded self-regulation, should be supported in consideration of the regulatory issues of the recent fourth industrial revolution. However, it should be noted whether the introduction of modern regulatory principles or legal systems contradicts and violates the general principles of regulations derived from the principles of the rule of law under the Constitution. When the government fully considers the various implications of good regulations and reflects them in the regulatory management system, reasonable regulatory reforms will be made that enhance the quality of regulations, not just deregulation.
