음주운전의 범죄에 있어서 입법상 여러 문제점 및 보완에 관한 논의

A Tentative Analysis of Some Problems in the Legislation of Drunk Driving and its countermeasures

음주운전 문제는 중국이 시급히 해결해야 할 큰 사회적 문제 중의 하나이다. 경제발전과 더불어 교통수단은 신속하게 증가하게 되었고, 특히 자가용의 수량이 많이 증가하게 되었다. 하지만 불량한 술문화로 인하여 음주운전 현상이 빈번하게 나타나고 있어서 “차 사고는 맹호 보다 더 무섭다”라는 말이 돌고 있다. 최근 몇 년의 대형 교통사고는 전 사회의 관심을 모으고 있으며 우려의 목소리가 날로 높아지고 있다. 중국은 제8차의 수정 형법을 통하여 음주운전 행위가 형법에 범죄로 입법화 된 후 양호한 교육적 역할을 하여 음주운전의 행위도 현저하게 억제되고 있는 결과 보고가 있는 반면에 음주운전 관련 입법의 문제점으로 인하여 사법 및 실무에 여러 난제를 주고 있는 것도 사실이다. 본문은 이러한 점에 대해서 분석 및 검토하여 보완의 대책을 제시하려고 한다. 특히 법률을 통하여 음주운전의 행위에 대한 강제성을 보장하고, 음주운전 사건의 발생을 억제하며, 음주운전에 대한 경계심을 강화하여 법의 적용과 실효성을 제고 할 것을 주장하고자 한다. 그 궁극적 목적은 음주운전과 관련한 입법상의 결함과 부족점을 검토하여 상응한 보완의 대책을 건의하는 데에 있다.

The problem of drunk driving has always been regarded as one of the most urgent problems to be solved in China. With the development of the economy, the number of vehicles has increased rapidly, the number of private cars has also increased. Coupled with the inheritance of wine culture, drunk driving becomes commonly. The tragedy of car accidents that have occurred frequently has aroused close attention from the society in recent years. Since drunk driving into the punishment, it played a good education in the social from all walks of life to guide, drunk driving behavior has been restrained obviously. However, due to the limitations of language and the lag of law,it is inevitable that there are deficiencies. These shortcomings must be corrected and improved in time to protect the law’s compulsory restrictions on drunk driving: reduce the frequency of drunk driving cases, enhance citizens’ vigilance against drunk driving, play the punishment role of criminal law totally and maintain the applicability and timeliness of the law. This article focuses on the defects and deficiencies in the legislation of drunk driving, and finally gives some Suggestions for the improvement of the crime of drunk driving, aiming to provide some suggestions for the crime of drunk driving to better reflect its social benefits. 醉酒驾驶问题一直以来都是中国亟待解决的一大问题。随着经济的发展，交通工具快速增加，私家车的数量也随之增加，再加之酒文化的传承，醉驾现象屡见不鲜。近年来频发的车祸惨案引起了社会的密切关注。醉驾入刑以来，对社会各界起到了良好的教育引导作用，酒后驾驶行为明显受到抑制。但由于语言的局限性以及法律的滞后性，存在不足也是难免的。对于这些不足就要及时得修正和完善，以保障法律对限制醉酒驾驶行为的强制性，降低醉酒驾驶案件发生的频率，增强公民对醉酒驾驶行为的警惕心理，真正发挥刑法的惩戒作用，保持法律的适用性和时效性。文章着重探析醉酒驾驶存在的立法方面的缺陷和不足，最后给出醉酒驾驶犯罪的改善建议，旨在为醉酒驾驶罪更好地体现其惩治犯罪的社会效益提供一点参考建议。
