The Individualized Intensive Probation System: Significance, requirements and problems

지난 2019년 우리 법제는 새로운 보호관찰제도를 도입하였다. ‘1대1 전담 보호관찰제도’가 그것이다. 당시 사회적으로 이슈가 되었던 성범죄자 문제에 대응하기 위한 일환으로 다른 나라에서는 찾아보기 힘든 새로운 전담보호관찰제도를 마련한 것이다. 1:1 전담 보호관찰제도는 긍정적인 면에서나 부정적인 면에서나 여러 의미를 지닌다. 어찌 보면 아주 독창적인 제도가 우리나라에 도입된 것이다. 그런데 아직 이를 제대로 규명하는 연구가 본격적으로 이루어지지 않고 있다. 이 제도가 지닌 심중한 의미를 고려할 때 이는 다소 의외라 말할 수 있다. 이러한 이유에서 이 글은 1:1 전담 보호관찰제도를 정면에서 분석한다. 1:1 전담 보호관찰제도란 무엇인지, 그 법적 성질과 요건은 무엇인지, 이에는 어떤 문제점이 제기되는지 살펴본다. 이 글은 특히 두 가지 문제에 초점을 맞춘다. 첫째는 1:1 전담 보호관찰제도가 말 그대로 보호관찰인지 아니면 실질적으로는 보안처분에 해당하는지의 문제이다. 둘째는 1:1 전담 보호관찰제도에서 중요한 요건인 ‘현저한 재범 위험성’을 어떻게 판단할 수 있는지의 문제이다. 이 글은 그중에서 첫 번째 문제에는 일도양단 식으로 대답하는 것은 어렵다고 주장한다. 왜냐하면 1:1 전담 보호관찰제도는 두 가지 성격을 모두 지니기 때문이다. 이러한 근거에서 실제 현장에서 이를 어떻게 운용하는지가 그 무엇보다도 중요하다고 주장한다. 이를 어떻게 운용하는가에 따라 보호관찰도 보안처분도 될 수 있기 때문이다. 그 점에서 이 글은 전담 보호관찰관의 역량과 역할이 그 어느 때보다 중요하다고 강조한다.

In 2019, the Korean legislation introduced a new probation system. This is the “Individualized (One on One) Intensive Probation System”. As a part of responding to the problem of sex offenders, which was a social issue at the time, a new intensive probation system was established that is difficult to find in other countries. The 1:1 intensive probation system has many meanings, both positively and negatively. In a way, a very original system was introduced in Korea. However, researches to properly identify this new system have not been conducted. Considering the profound meaning of that system, this can be said to be somewhat surprising. For this reason, this article analyzes the 1:1 intensive probation system intensively: What is the 1:1 intensive probation system, its legal nature and requirements, and what problems arise. This article focuses specifically on two issues. The first is the question of whether the 1:1 intensive probation system literally corresponds to probation or actually security measures. The second is the question of how to judge the ‘significant risk of recidivism’, an very important requirement in the 1:1 intensive probation system. This article argues that it is difficult to answer the first question in a one-way. This is because the 1:1 intensive probation system has both characteristics. On this basis, it is argued that how to operate it in the actual field is more important than anything else. This is because, it can be either a probation or a security measure, depending on how it is operated. In that respect, this article emphasizes that the capability and role of a intensive probation officer is more important than ever.
