A Study on the Constitutional Issues of AI Prediction based on Big Data

최근 지능정보 사회의 도래로 사회의 많은 부분이 변화하고 있다. 표면적인 사회변화뿐만 아니라 헌법상 기본권의 변화도 엿보인다. 이러한 변화의 가운데 인공지능이라는 기술이 있다. 지능정보사회의 핵심기술인 인공지능(AI)은 사물과 정보, 기계와 사람, 현실과 가상을 넘나드는 융합의 시대로 견인하고 있다. AI는 데이터의 수집, 해석, 예측, 이용, 추적과정을 순환하면서 학습하는 기술이다. AI의 핵심적 기능인 예측력은 법적, 사회적 쟁점 해결에 유용한 기능을 제공한다. AI예측력은 단순한 유용성을 넘어 민주주의 본질과 사회 패러다임을 변화시키고 있다. AI의 예측력 기능은 완벽에 가까운 무오류성, 문제해결을 위한 적절한 대안의 제시 등 긍정적 영향을 준다. 그러나 AI가 어떤 과정을 거쳐 특정 결론을 내렸는지를 알 수 없는 블랙박스화, 편향적 정보의 습득에 의한 차별문제 등의 부정적 영향도 있으므로 이에 대한 검토가 필요하다. 지능정보사회의 도래는 새로운 규범체계의 정립을 요구하고 있다. 거시적으로는 새로운 헌법상 이념이나 원칙의 변화를 요구하고 있다. 또한, 이러한 변화를 예견하고 대응할 필요성이 대두되고 있다. 본 연구는 이러한 문제의식에서 출발하여 AI 예측기능을 중심으로 새롭게 논의되어야 할 쟁점을 발굴하고 이를 현실적으로 반영할 수 있는 구체적 대안을 제시하고자 한다.

The latest advent of the intelligent information society is leading to a change in many parts of society. It is observed not only a superficial social change but also a transition in fundamental rights under the constitutional law. There is the so-called AI technology in the middle of these changes. AI(Artificial Intelligence), which is the key technology of Intelligent Information Society, is driving an era of convergence that frequently crosses between things and information, between machines and people and between real reality and virtual reality. AI is the technology of learning with circulating the process of collecting, interpreting, predicting, using and tracking data. The predictive power, which is the core function of AI, offers useful function for solving the legal and social issues. The AI prediction is changing the essence of democracy and the paradigm of society beyond mere usefulness. The function of predictive power in AI is giving positive effects such as the near-perfect error-free and the suggestion of appropriate alternatives to solve the problem. However, there are also negative impacts such as the blackboxing pattern unavailable for knowing what process AI went through to make a particular conclusion, and the problem of discrimination due to the acquisition of the biased information. Thus, there is a need to review this. The arrival of intelligent information society is requiring the establishment of a new normative system. There is a macroeconomic call for a new constitutional change in ideology or principle. Also, there is a growing need to anticipate and respond to these changes. This study is aimed to find an issue, which needs to be newly discussed focusing on the AI prediction function, with starting from this critical mind, and to present a concrete alternative plan available for reflecting this realistically.
