의료과오소송에서 과실상계에 관한 일고찰(一考察)

A Consideration on Comparative Negligence in Medical Malpractice: Focus on Mentally Ill Patient Suicide Cases and Contributory Negligence in the United States

정신과 의사 및 이와 관련된 일에 종사하는 의료인이 자살하려는 환자를 자해로부터 보호하지 못한 것은 의료과실의 원인 중에 하나이다. 사실 의사는 특정 환자가 심지어 최상의 상태에서 치료를 받고 있는 중에도 언제든지 자살을 시도하려는 성향을 나타낼 수 있기 때문에 이러한 시점을 정확하게 예견하는 것은 쉽지 않다. 이러한 이유로 법원은 정신적으로 이상이 있는 환자가 어떤 상황에서 어느 정도까지 자신을 스스로 보호해야 할 책임이 있는지를 판단함에 있어 많은 어려움에 직면하고 있다. 본 논문은 정신질환자의 자살과 관련된 의료과오소송에서 미국의 기여과실 법리의 적용을 면밀히 고찰하고자 한다. 이를 위해 제2장에서는 미국법상 의료과오소송에서 기여과실에 대한 법적 쟁점을 몇몇 판례와 함께 심도 있게 검토하고자 한다. 제3장에서는 자살환자에 있어 기여과실 법리에 대한 고찰을 중심으로 특히 입원환자와 외래환자처럼 서로 다른 상황에서의 환자의 자기보호의무에 대한 검토와 함께 기여과실 법리 분석에 대한 근거 및 국내의 논의 쟁점에 주목하여 분석하고자 한다. 그리고 마지막인 제4장에서는 위에서 비교･검토한 내용을 토대로 우리 법원에 제시할 수 있는 유의미한 내용을 시사점으로 제시하고자 한다.

For psychiatrists and mental health care providers, failure to protect patients who are trying to commit suicide from self-harm is one of the causes of serious medical malpractice. According to a study, more people are committing suicide each year in the United States than the number of deaths resulting from homicide. Physicians act in an environment where it is difficult to accurately foresee a particular patient s inclination to commit suicide, even when he or she is being treated in the best condition. In this case, the court faces many difficulties in determining under what circumstances and to what extent a mentally ill patient is responsible for taking care of themselves. This article seeks to scrutinize the application of the theory of contributory negligence in medical malpractice related to the suicide of patients in the United States. To this end, Chapter 2 seeks to examine in-depth, the legal issues of contributory negligence in medical malpractice under the United States laws. Chapter 3 focuses on the consideration of contributory negligence in suicide patients, and examines the self-protection obligations of patients, especially in different situations, such as inpatient and outpatient settings, and focuses on domestic discussion issues. And the final chapter, Chapter 4, presents meaningful suggestions that can be presented to our court based on the comparison and review above.
