주취자와 관련하여 발생하고 있는 다양한 사회적 문제들은 전통적으로 관대한 음주문화에 따른 제도적 흠결로 미온적인 제지가 이루어지면서 오랫동안 지속되어 왔다. 그러나 최근 들어 경찰서, 의료기관등 공공기관에서의 난동으로 공무집행방해 등 주취자에 의한 범죄가 증가하고 있다. 이로 인해 주취자의 범죄예방을 위한 보호조치로 과다한 경찰력 투입으로 범죄예방과 주민봉사 등에 대한 치안서비스의 질이 저하되어 개인적·사회적 폐해와 상당한 국가 경제적 손실이 야기되고 있다. 이에 따라 주취자 문제에 대하여 음주문화의 개선, 주취자 보호조치에 대한 개선, 비용의 감소 등에 관한 엄중하고도 적절한 주취자 조치에 대한 법제도적 개선의 정당성과 필요성이 제기되고 있다. 주취자 보호조치와 관련하여 보호조치에 관한 근거의 미비, 주취자 판단기준의 추상성 및 보호주체의 모호성, 비 응급· 단순 주취자에 대한 보호조치 및 제재 수단 미흡, 음주소란에 따른 경미한 범죄에 대한 처벌수준 미미 등 법적인 문제점 그리고 보호조치에 관한 유관기관의 협력 미흡 등 제도적인 문제점이 제기되고 있다. 따라서 이글에서는 주취자의 보호조치에 대하여 다양하게 제기되고 있는 문제점들을 외국의 입법례 및 운영사례를 검토하여 시사점을 얻고 주취자 보호조치에 대한 법제도적인 개선방안을 제시하고자 한다.
The various social problems associated with drunkards have long been sustained by lukewarm deterrence due to institutional flaws caused by the traditional generous drinking culture. Recently, however, crimes committed by drunken people, such as obstruction of justice and disorder, have been increasing due to breaking into public institutions such as police stations and medical institutions. Excessive police force is used to protect drunkards from crimes, which reduces the quality of security services for crime prevention and community service, causing personal and social harm and considerable national economic losses. As a result, the need and need for legal improvement on drunks issues are being raised for strict and appropriate drunks measures on improving drinking culture, protecting drunks, and reducing costs. In addition, legal issues such as lack of grounds for protection of drunkards, abstraction of criteria for determining drunkards, lack of protection and sanctions for non-emergency and simple drunkards, and lack of cooperation by related agencies. Therefore, this article intends to review foreign legislation and operational cases concerning various problems arising from protection measures and sanctions of drinkers to obtain implications and propose legislative improvements to protect drinkers.
