사회적 부패방지를 위한 이해충돌방지 입법에 관한 연구

이해충돌방지법과 토지거래규제 입법을 중심으로

부패개념에서 광범위하게 사용되는 대표적인 개념을 든다면, 사적 이익을 얻기 위하여 위임된 권력을 남용하는 이해충돌을 들 수 있다. 이해충돌은 공적 의무와 공직자의 사적 이익사이의 충돌로서, 공직자의 직무와 관련한 공익과 사익사이의 충돌이나 갈등상황을 의미한다. 이해충돌은 공적 문제에 있어서 정책결정권의 지위에 있는 자가 공적 이익과는 다른 이익을 가지는 경우에 광범위하게 발생할 수 있다. 따라서 이해충돌을 통제하고자 하는 윤리입법의 목적은 헌법적 민주주의의 당연한 귀결이며, 그에 따라 이해충돌을 방지하고자 하는 궁극적인 입법의 목적은 시민의 보호라고 할 수 있다. 궁극적으로 공직자는 지위의 남용이나 충돌의 외관은 피해야 하며, 통상적인 정부서비스를 받는 비용을 지불하는 시민들을 보호해야 한다. 이해충돌을 규제하는 접근방법은 일반적으로 세 가지 유형으로 구분할 수 있다. 고지의무, 선택적 규율, 절대적 금지의 형태가 그것이다. 최근에 이해충돌방지법이 제정되었다. 이러한 이해충돌방지에 관한 규율은 이해충돌방지법 외에도 공공주택특별법, 한국토지주택공사법, 공무원 행동강령 등에서도 개별 규정을 두고 있다. 이해충돌방지법의 제정은 청탁금지법, 이해충돌방지법뿐만 아니라 그 밖의 공직자윤리법 등 반부패법령을 통합하고 부패관련 법체계를 정비할 수 있는 기초를 마련하였다는 점에서 그 의의가 있으며, 종국적으로 부패방지에 관한 통합 법률의 제정에 기여할 것으로 기대된다.

Recent studies have been shown that bureaucratic corruption in Republic of Korea is organized and structured. In other words, it is a form of ‘systemic corruption’. It has a tendency to generate and expand its power within organizations or society through myriad informal network. Within a organization/social system, they cement each other and expand and contract over time. That is, it serve as critical mechanisms itself to operate bureaucratic corruption systemized. However, very little attention has been paid to the factors that produce and enlarge the corruption network. Much previous research has focused on controlling corruption such as approaching methods and strategies. We have to understand the nature of problem rather than find bureaucratic corruption controlling mechanism because the corruption network operates with very complex factors to generate and expand in organizations. In this paper, I will rely on an interdisciplinary approach based on the integrated model of structure-behavior to analyse the nature of corruption network. Seen from this point of view, this study test theories of bureaucratic corruption generation and corruption networks using DEMATEL method. The expert members participated to evaluate the relationships between critical factors to corruption networks.
