자치경찰위원회의 정치적 중립성 확보 및 민주적 통제 방안

Ensuring political neutrality and Democratic control of municipal police committee through general revision of Police Act

본 연구의 목적은 기존의 경찰법이 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」로 전부개정됨에 따라 대한민국의 자치경찰제도 도입 및 시행에 따른 자치경찰위원회의 민주적 정당성 검토, 정치적 중립성 보장 및 민주적 통제 방안의 확보에 관한 고찰이다. 자치경찰제 도입 및 시행과 더불어 한국형 자치경찰제의 가장 중추기관으로서 신설된 자치경찰위원회는 시도지사 소속의 합의제 행정기관으로서 민주적 정당성을 가지며, 정치적 중립성이 법적·제도적으로 보장된다. 자치경찰위원회는 자치경찰사무를 심의·의결하는 역할을 담당하고, 자치경찰위원회의 위원의 정치적 중립의무와 권한남용금지, 임기 및 신분 보장 등 정치적 중립성이 보장되어 있다. 그러나 이에 비해 자치경찰위원회가 가지는 권한에 대해 국가경찰이 개입할 가능성이 높고, 시도경찰청장 등 경찰공무원을 직접적으로 지휘·감독할 수 없는 등 권한배분의 불균형을 이루고 있으므로 제도의 미비점을 보완하고 자치경찰위원회의 정치적 중립성을 보장하기 위한 방안이 필요하다. 한편 정치적 중립성이 보장되는 만큼 자치경찰위원회에 대한 민주적 통제도 역시 확보되어야 하는바, 개정 경찰법에서는 자치경찰위원회의 추천권, 시도지사의 재의요구권 등이 규정되어 있고, 지방자치법에서는 행정감사제도 등 기본적인 통제 시스템은 갖추고 있다. 그러나 경찰통제의 기본요소를 포함하는 민주적 통제 방안이 추가로 요청되므로, 지방의회의 권한 강화, 지역주민의 참여 보장, 합의기구 등 입법 개선이 필요하다.

The purpose of this study is to consider examination of democratic legitimacy for municipal committee, ensuring political neutrality and democratic control of municipal committee after general revision of Police Act(‘The Act on Organizational system of National police and autonomous police’) which has enforced autonomous police system. Municipal police committee which was founded as vital organ of korean municipal police system has democratic legitimacy of collegiate administrative agency as affiliated organization for governor of local government, is ensured political neutrality legally. Municipal committee considers and decides policing affairs of local police and is ensured political neutrality e.g. duty of political neutrality, prohibition of power abuse, security of tenure and status. But the scheme of political neutrality’s qurantee is required because imbalance of the authority distribution which includes intervention of national police, absence of authority of direct command supervision to police officer and so on. In the meanwhile, to ensure democratic control over municipal police committee as much as political neutrality, there are acts, e.g. the right of recommendation for municipal police committee and authority of request for reconsideration and system of cotrol system e.g.. administration inspection. But additional democratic is required including element of police control so revision is needed e.g. to strengthen authority of local assembly, resident participation, organization.
