A Review on the Legislation of Road Traffic Information Collection

Changes in our society bring many kinds of shifts to us. In particular, development in transformation and communication makes us to share similar cultures with the other people in different countries around the world. Cultural movements among nations now are not any more strange in our lives. In this era, the transportation has been improved more than ever before. Sharing cultures and transportation effectiveness cause global people to be unified. As an evidence of it, each nation makes its effort to unite a great variety of cultures throughout the world. Especially, it seems that European countries struggle to unify them to get back their powers again from the United States that they had obtained in the past. Local self-government and the police presently continue to install CCTV on the roads around the nation. It is to collect and provide traffic informations. By doing that, it is very useful to keep traffic safety as well as to give convenience to traffic users. Thus, local self-government and the police should come up with effective measures to gather more systematic traffic-related data and to offer the data rapidly to traffic users. The study first reviewed laws regarding the accumulation of the traffic information which is to collect and manage the information efficiently, because storing traffic data and its application are important in the society. The second chart, as a general insight into collection of traffic information, dealt with its meaning and category. The third handled its legal bases and characteristics, and then the last one reviewed the legal status of the local self-governing communities which store traffic informations. Local self-government can pile up simple unauthoritative traffic information that is a part of their works, but in the case of authoritative one it is possible only when there is a specific legal commitment to those. To do productively, it is necessary to unify and specify the law on traffics. In addition, the purpose of gathering data is to furniture those with traffic users and to increase well-fare of local residents around the country. The president of a local self-government should, therefore, have the authority to collect the traffic information. In present, a law-based democracy operates local self-government to protect the rights of local residents. So a local self-government is given a legal authority to do its business by itself, because it has a right of self-government administration which is in the category of local self-government. The traffic information collection should be regarded to be the administrative work of the local self-government.
