대한민국의 안보형사법제는 전통적으로 북한의 대남혁명전략에 대한 대응을 1차적 목표로 운영되어 왔으나, 최근 급변하는 국제정세와 급속도로 발전하는 과학기술은 우리의 안보환경을 다변화시켰고, 그에 따라 국가가 보호해야 할 안보 영역과 범위는 더욱 넓어졌다고 할 수 있다. 전통적인 안보형사법 영역으로는 국가보안 범죄(체제안보), 출입국 범죄(국경안보), 테러 등을 들 수 있으나, 국가경제·국민생활에 심각한 타격을 줄 수 있는 기술유출 범죄(경제안보), 사이버 테러(정보안보) 등도 그 중요성 및 파급력에 비추어 새로운 안보형사법의 영역으로 편입하여 국가안보 관점에서 접근 및 대응방안을 준비할 필요가 있다고 하겠다. 본 발표문에서는 위와 같은 전통적인 안보형사법 영역뿐만 아니라 새로운 안보형사법영역으로 포함시킬 수 있는 영역에 대하여 우리 사회에서 발생하는 주요 사례들과 그에 대한 법제를 간단히 소개하고, 각 영역별로 주요 외국의 법제 및 대응 시스템을 간략히 살펴본 후, 우리 현실에 맞는 실무상, 법제상 개선점을 모색해 보고자 한다.
The national security and criminal law in Republic of Korea against threats to national security has traditionally been operated with the primary goal of responding to North Korea s revolutionary strategy toward South Korea. However, constant changes in international environment and rapid progress in scientific technology have diversified our security environment, and the range and scope of national security which should be protected by the State have been broadened. Traditionally, the field of national security and criminal law against threats to national security includes crimes against national security(security of the regime), crimes of illegal immigration(border security), and terrorism. However, various kinds of crimes such as crime of espionage, cyber terrorism(information security) should be incorporated into the realm of new criminal law against threat to national security in light of its importance and influence and prepared for its countermeasures in perspective of national security. This study briefly introduced the major cases in our society and the legislative system about the area that can be included as a new criminal law against threats to national security as well as the national security and criminal law on national security. In addition, it briefly reviewed the foreign legal systems and response system in related issues, suggesting improvements in practice and law in Korea.
