공인 탐정 업무 지정에 따른 자격시험 교과 개발에 관한 연구

이 연구는 우리 사회가 고도화로 발전한 만큼 모든 국민은 안전한 삶과 범죄로부터의 보호를 원하고 있지만, 국가는 국민이 체감할 만큼의 안정된 치안을 제공하지 못하고 있다. 국가의 공권력은 어느 순간부터 중요 사건, 강력 사건 등 사회 이목이 쏠리는 사건으로 ‘선택과 집중’하기 때문이다. 이로 인해 국가가 제공하는 치안 서비스에 불만을 가진 국민은 자비를 부담하더라도 더 나은 서비스를 받고자 하는데 그 대안이 ‘탐정’과 같은 직업을 통해서이다. 2020년 현재 OECD 37개국 가운데 우리나라를 제외한 국가 대부분은 치안 서비스를 보완할 ‘탐정’의 직업을 인정하고 그들에게 치안의 공백을 메울 수 있는 역할을 부여하고 있다. 하지만, 우리나라에서 ‘탐정’은 ‘흥신소’, ‘심부름센터’와 같은 부정적 이미지가 강하고 이들이 하는 업무 역시 ‘뒷조사’로 치부하고 위법 행위로 규정하여 조사 결과에 대해서 정당성을 인정하지 않고 있다. 21대 국회에서 ‘탐정’ 관련 입법을 약속한 바 있는데, 부정적인 이미지를 지우고 올바른 ‘탐정’의 업무 수행을 위해서는 국민의 신뢰가 바탕이 되어야 할 것이다. 이에 본 연구는 국가가 인정한 자격을 가진 자만이 탐정 업무를 할 수 있는 ‘공인 탐정’을 제언하며 이에 따라 ‘공인 탐정’ 자격 취득과 관련된 시험의 교과목 지정과 취득한 자격을 가진 자가 수행할 수 있는 업무의 범위를 명확히 규정하자고 한다.

In the advanced society, citizens want safety and crime prevention. However, recently, the government has tended to focus only on socially influential cases, so citizens feel that the government does not provide enough safety services. Therefore, citizens want to receive better safety services that the government cannot provide through detectives. As of 2020, most of the 37 OECD countries except South Korea recognize detective to supplement safety services and give them a role to fill the gap in public safety. However, in South Korea, detectives have negative perceptions, and the Korean government defines detective activities as illegal and does not recognize their legitimacy. Therefore, the trust of citizens should be prioritized to establish detective services in Korea. In this paper, we propose the concept of the authorized detective, which allows only government-approved people to act as a detective. Accordingly, we specify the subjects of the qualification test and define the scope of the activities of detectives.
