유럽시민발의와 유럽연합 참여민주주의

The European Citizens Initiative and Participatory Democracy of the European Union

유럽시민발의는 리스본 조약에 의해 유럽연합의 참여민주주의 강화와 민주주의적 기능개선을 목적으로 도입되었다. 2012년 4월 1일 발효된 이후 2015년 9월까지 약 60개의 시민발의안이 제기되는 등 시민발의는 유럽시민의 유럽연합 정책에 대한 의사표명 방법 중 하나로 자리 잡았다. 그러나 그 중 3개의 발의안만이 유럽집행위원회의 발의 검토를 받았으며 결과적으로 단 하나의 발의만이 공식발의로 인정받은 점을 감안하면 참여민주주의 강화라는 유럽시민발의의 목표까지는 아직 요원하다고 할 수 있다. 이 같은 저조한 성공률은 유럽시민발의 시행에 장애가 되고 있는데, 그 원인으로는 유럽시민발의 제도 내 한계점과 유럽시민발의에 대한 유럽집행위원회의 태도를 들 수 있다. 유럽시민발의조직자들은 시민위원회를 조직할 때부터 집행위원회로부터 공식발의로 인정받기까지, 수많은 행정적, 재정적, 기술적 문제와 한계점에 부딪히고 있으며 이러한 부담들은 일반 시민들이 자유롭게 발의를 제기하지 못하도록 하고 있다. 발의 조직가들이 일반 시민이 아니라 NGO나 사회단체, 심지어 로비스트와 관련이 있을 것이라는 의혹까지 제기되고 있는 것은 바로 이러한 이유에서다. 집행위원회의 시민발의에 대한 소극적인 태도는 시민발의의 활성화를 더 어렵게 만들고 있으며 이 한계점과 문제들은 유럽시민발의의 원 목적을 왜곡시킬 수도 있어 일반시민들은 물론, 2014년 이후에는 유럽연합 기관들 역시 유럽시민발의의 개선에 대한 필요성을 인식, 공감하고 있는 상황이다.

To improve democratic function of the European Union (EU) in general and to reinforce participatory democracy in the EU in particular, the Treaty of Lisbon introduced the European Citizens’ Initiative (ECI). While almost sixty ECIs have been proposed by the European citizens so far since April 1, 2012, the effectiveness of the ECI as a new instrument for participatory democracy in the Member States of the EU remains a subject of controversy. For instance, the European Commission managed to examine only three of those sixty ECIs and to approve one at the end of ECI procedure. Doubts has been raised whether this limited application of an ECI could contribute to the development of the participatory democracy in the EU. The administrative, financial and the technical burdens arising from the ECI implementation (e.g., the collection of one million signatures from more than 7 Member States) forced the organizers to associate with the special interest groups like NGOs, social associations and even lobbyists, and made it difficult for the European citizens to come up with proposals for the ECIs. Furthermore, the negative attitude of the European Commission about the ECI complicated the application of the ECI and its original mission might have been diluted to the point of its distortion.
