정치자금 소액기부의 제도 효과와 저해 요인들

The Effect of Small Donation and Factors of Causing Its Negative Effects

소액기부 제도는 민주주의의 가치 실현을 위한 좋은 취지의 제도이지만, 청목회를비롯한 이익집단의 입법로비 사건은 바람직한 제도라 할지라도 나쁜 제도적 효과를 낳을 수 있음을 보여주었다. 본 연구는 소액기부의 제도적 효과를 2005년 이후의 정치자금 기부금 현황을 통해 살펴보면서, 소액기부가 제 기능을 발휘하는데 있어 그 저해요인이 무엇인지 조사해 보았다. 분석결과, 현행의 소액기부 제도는 정당 간 정치자금조달의 형평성 차원에서는 일익을 하고 있는 것으로 나타났다. 반면 소액기부를 통한국민들의 정치참여는 여전히 정체되고 있으며, 정치후원금 중 고액에 대한 의존도도 크게 개선되지 않고 있는 것으로 나타났다. 세액공제 혜택을 주는 현행의 소액기부 제도는 정치후원금제도가 활성화 되지 않을 것을 상정하고 국고보조금 형태로 운영되고 있는 것이 큰 문제로 지적된다. 정치적 의사표현의 자유를 제한하는 규제 지향적 제도아래서 이익집단의 악용, 적극적이지 못한 정치참여, 정치자금 기부에 대한 부정적 인식이 좋은 취지의 제도를 바람직하게 작동하지 못하게 하고 있다.

This article examines why small donations that seek democratic values of equality and expression lead to negative effects of political fund donations. The effects of small donations may be constrained when big special interests donors overwhelm political money donations while participation among donors is inactive, although they may contribute to political equity for financing of political parties. Analyzing statistical records which report all donations of political funds since 2005, I find that small donations do not work well because of large donations and sluggish supports of small donors. In addition, this article presents that tax deduction which assumes political money contributions are not compatible with our expectations so they are subsidized by the government is of another concern to small donation. Finally, this article concludes that big special interests donations, inactive participation among donors, and the negative perception of political money contributions are in part due to regulatory control of korean political system.
