블록체인의 성립과 운용에 있어서 민사법적 쟁점

Civil Law Issues in the Establishment and Operation of the Blockchains: Based on the Technical Understanding of the Blockchains

블록체인은 ‘분산 공개 원장’이라고 일컬어지는 것으로, 중앙집중 기관이나 시스템의 간섭 없이 익명의 다수인에게 정보를 유통시키면서 여러 가지 컴퓨터 프로그래밍 기술 등을 활용하여 정보의 위변조를 어렵게 만드는 기술이다. 블록체인은 획기적인 기술이기는 하나, 다수의 참여자에게 똑같은 내용의 정보를 각각 모두 보유하도록 하는 비효율적인 방식을 통해 비로소 성립하는 것이어서, 경제적 비효율을 감수하더라도 탈중앙화와 익명성 보장이 반드시 필요한 영역에서 사용되는 것이 바람직하다. 이 글에서는 먼저 법적 쟁점 분석의 전제로 블록체인의 기술적 특징을 상세히 설명하고, 암호화폐와의 관계도 간략히 소개하였다. 특히 블록체인 기술과 다른 유사 기술사상, 예를 들어 코드화 내지 디지털화, 암호화기술, 내용검증 장치 및 Peer to peer 등을 구별하면서 블록체인 고유의 민사법적 쟁점을 도출하고자 하였다. 블록체인의 성립과 운영을 둘러싼 민사법적 쟁점으로는 블록체인 참여자들의 지위와 책임 문제, 블록체인 위에서 발신된 의사표시의 취급 등을 거론할 수 있을 것이나, 이 외에도 아직까지 생각지 못한 여러 가지 민사법적 문제점이 발생할 수 있을 것이다. 이 글이 블록체인 기술에 대한 이해를 높이고, 블록체인 자체에서 발생할 수 있는 법률문제에 대해 인식하고 해결책을 찾는데 도움이 되기를 바란다.

Blockchain, so-called ‘distributed public ledger’, is a technology that makes it difficult to forge or falsify information by using various computer programming technologies without interference from centralized institutions or systems. Blockchain is definitely a groundbreaking technology, however, it is only established through an inefficient way of allowing multiple anonymous peers to have all of the same information. Therefore, it is desirable to use it in areas where decentralization and anonymity are essential, even at the cost of economic inefficiency. In this article, the technical characteristics of blockchain are explained in detail as a premise for analyzing legal issues, and the relationship with cryptocurrency is also briefly introduced. In particular, it was attempted to distinguish blockchain technology from other similar technological ideas, for example, codification or digitalization, cryptography, content verification devices, peer to peer, etc., to derive civil law issues unique to blockchains. The civil law issues surrounding the establishment and operation of a blockchain may include the following: the positioning and responsibility of blockchain participants, the handling for the manifestation of intention sent on the blockchain, etc. In addition to these, a number of civil law issues that have not yet been considered may arise. I hope that this article may contribute to understanding the blockchain technology, recognizing the legal issues around the blockchain itself and finding their solutions.
