A Study on Claim for Restitution of Unjust Enrichment from the Uncompensated Land - Focusing Litigation Case Against Local Government -

For implementation of a public work, the loss from the land to be transferred should be compensated by the Land Compensation Act. The New Village Program in 1970 was a national campaign to improve the living environment. However, those lands wereńt compensated fully by the state the uncompensated land. Recently, each local government compensates those legal owners for their yet-to-be-paid land, but facing litigations for restitution of unjust enrichment owing to delayed compensation. Hence, the purpose of this thesis is to protect the rights and interests of the owner of the uncompensated land for public service with legal consideration.
