A Study on Analysis of Public Project Compensation Civil Petition

These days public lands are needed for resolving various social problems caused by industrialization, urbanization and individualization, but individuals’ right to property have to be restricted for public interests. Under this situation, obligations appropriate for public good and public expropriation for public needs are increasing. The purpose of this study is to provide the basic foundation for improving the current compensation system by conducting analysis on civil petition cases of the Ministry of Land, Transport and Maritime Affairs in order to make systematic procedures and standard for damage compensation in implementing public projects and improve various unreasonable system. In addition, the purpose of this study also includes implementation of efficient public projects and protection of rights and interests of those who are affected by the public projects. This study analyzed civil petitions of compensation made in civil petition place of the Ministry of Land, Transport and Maritime Affairs from January 1, 2009 to May 30, 2011.
