젠더폭력 과거청산, 어떻게 할 것인가?

Gender-based Violence by the State and Challenges for Transitional Justice: The Tasks of the Korean TRC through South African TRC s Attempts

1990년대 후반에 활동했던 남아공 TRC는 여성 특별 청문회를 열고 과거사 젠더폭력 사건의 진상을 규명하기 위해 선구적으로 노력했으며, 이후 여러 나라의 과거청산 과정에 영향을 미쳤다. 한국은 남아공과 과거청산의 과제와 조건 면에서는 차이가 있으나, 남아공에서 과거청산 과정에 이행기 정의와 젠더 정의를 통합하려고 노력했던 점은 우리에게 많은 시사점을 준다. 한국 사회에서 과거사 젠더폭력 사건은 반공주의와 권위주의, 가부장주의 등 여러 겹의 억압 속에 젠더폭력과 국가폭력과의 교차지점에 있기에 진상규명이 쉽지 않다. 그러나 가해의 책임이 국가에 있기에 국가기구가 나서서 성 인지적 과거청산을 수행할 때 실체를 드러낼 수 있다. 진실화해위원회는 이를 위해 위원회 안에 ‘과거사 젠더폭력 전담 조사팀’을 구성하여 전문 조사관을 충원하고 양성할 필요가 있다. 피해자들이 신청하고 증언할 수 있는 환경도 조성해야 한다. 과거사 젠더폭력 전담 조사팀은 개별 신청사건 조사 외에도 진실화해위원회의 직권조사를 통해 사례를 수집하고 종합하여 ‘과거사 젠더폭력 백서’로 발간할 수 있을 것이다. 그리고 별도의 ｢조사･심의 매뉴얼｣을 마련해야 한다. 이 매뉴얼에는 ① 진술조사 과정에서 피해자의 트라우마 재경험 완화, ② 조사와 심의･의결, 조사 결과 발표에 이르는 진실규명의 전 과정에 피해자 신원 보호와 2차 피해 방지, ③ 사후 조치에 관한 규칙을 담을 필요가 있다.

In the late 1990s, South Africa’s TRC held a special hearing for women and pioneered efforts to clarify the truth of past gender-based violence, which later influenced the process of transitional justice in various countries. South Africa has tried to integrate the gender justice in the transitional justice process, which gives us many implications. In Korean society, the case of gender-based violence by the state in past is not easy to find out because it is at the intersection of gender-based violence and state violence in the oppression of many layers such as anti-communism, authoritarianism, and patriarchalism. However, since the responsibility of violence is in the state, the state organization can reveal the reality when it comes to realizing gender justice. Therefore, the Truth Reconciliation Committee will form a ‘a dedicated team to investigate gender-based violence by the state in past’ in the Committee and recruit and train professional investigators. And it is necessary to create an environment where victims can apply and testify. In addition to the individual application case investigation, the investigation team will be able to collect and compile cases through the investigation of the Truth Reconciliation Committee and publish them as ‘White Paper on Gender-based Violence by the state in past’. And a separate “Manual of Investigation and Deliberation” should be prepared. This manual needs to contain the following rules: 1 relief of trauma reexperience of victims during the investigation of victim statements, 2 prevention of victim identity exposure and secondary damage in the investigation, deliberation and resolution process, 3 support and protection of victims after investigation.
