지방자치단체의 자치경찰 조례 분석에 관한 연구

A Study on the Analysis of Local Government Autonomous Police Ordinances

본 연구는 지방자치단체 자치경찰 조례를 분석하는데 목적이 있다. ｢국가경찰과 자치경찰의 조직 및 운영에 관한 법률｣이 제정됨에 따라 광역자치단체를 중심으로 ｢자치경찰사무와 자치경찰위원회의 구성 및 운영에 관한 조례｣를 제정하고 있다. 조례의 제정은 자치경찰제의 도입을 위한 제도적인 근거를 마련하고 실질적인 운영에 필요한 사항을 규정하고 있다. 본 연구를 위해 “자치법규정보시스템”을 통해 총 16개 지방자치단체의 조례를 분석 대상으로 하였고, “기술적 연구에 따른 내용 분석 방법”을 통해 연구를 수행하였다. 조례가 제정된 지역은 7개이며, 입법예고 중인 지방자치단체는 9개이다. 분석결과 사무 범위는 타 지방자치단체와 달리 강원 및 충북의 경우 자치경찰청장과 협의 및 조정하도록 하였고, 사무의 경우 생활안전 사무가 67.44개, 교통활동 사무가 57.69개로 나타났다. 사무기구는 위원회 운영을 위해 간사를 두고 있는 경기, 강원, 세종과 더불어 사무국의 설치를 규정한 지역은 경기, 강원, 충북이었다. 예산 제출기한은 지방자치단체별로 상이하였다. 본 연구가 자치경찰의 운영 효율화를 가져오길 기대하며, 향후 정책방향으로 국가예산지원, 협의회 구성 법률제정, 자치경찰과 지방행정의 연계 등이 필요하다.

The purpose of this study is to analyze local government autonomous police ordinances. With the enactment of the 「Act on the Organization and Operation of National Police and Autonomous Police」, metropolitan governments are enacting 「Ordinance on the Organization and Operation of Autonomous Police Affairs and Autonomous Police Committee」. The enactment of the ordinance prepares the institutional basis for the introduction of the autonomous police system and stipulates necessary matters for practical operation. For this study, the ordinances of a total of 16 local governments were analyzed through the “autonomous law information system”, and the study was conducted through the “content analysis method according to technical research”. There are 7 regions where ordinances have been enacted, and 9 local governments are in the process of announcing legislation. As a result of the analysis, the scope of office work, unlike other local governments, was consulted and coordinated with the head of the Autonomous Police Agency in Gangwon and Chungbuk Province. In addition to Gyeonggi, Gangwon, and Sejong, where secretariats are located for the operation of the committee, the regions that regulated the establishment of the secretariat were Gyeonggi, Gangwon, and Chungbuk. The deadline for submitting the budget was different for each local government. It is expected that this study will bring about efficiency in the operation of autonomous police, and future policy directions include support for the national budget, enactment of laws to organize councils, and linkage between autonomous police and local administration.
