역사부정죄의 도입에 관한 소고

A Study on the Introduction of Law against History Denial

최근에 역사부정행위에 대한 처벌 규정을 마련한 법안으로는 ｢참전유공자 예우 및 단체설립에 관한 법률｣ 일부개정법률안(429, 박완수의원 대표발의), ｢천안함 생존 장병 지원 등에 관한 특별법안｣(2454, 한기호의원 대표발의), ｢역사왜곡방지법안｣ (10105, 김용민의원 대표발의) 등이 있다. 이러한 법안들은 헌법상의 과잉금지원칙을 위배하여 표현의 자유를 침해할 가능성이 있다. 또한 현실적으로 보았을 때, 모든 역사적 사실에 대한 개개인의 주장, 판단 및 평가에 대하여 제재하는 것은 불가능하며, 특정한 역사적 사건에만 한정하여, 그 사실의 부인･비방･왜곡･동조･찬양･고무･선전 등의 행위를 처벌할 경우, 그에 관한 형평성의 문제가 제기될 수 있다. 그러나 역사부정죄 처벌법 제정의 필요성을 상당수의 국민이 인정하고 있는 이상, 그 의견에 대한 조화로운 반영이 필요한 실정이다. 최근에 통과된 ｢5･18민주화운동 등에 관한 특별법｣ 일부개정법률안에서 ‘허위사실의 유포’만을 처벌행위로 규정한 것과 같이, 처벌행위의 유형을 최소화하고, 처벌수위도 그와 유사한 수준으로 조정할 필요가 있다. 역사적 사건에 대한 평가 및 판단, 그 사고 과정은 개인의 신념과 주관에 따라 달라질 수 있다는 점, 역사적 사안과 관련한 개개인의 주장 또는 견해에 대하여 옳고 그름의 판단 기준 및 그 기준의 존재 여부에 관하여 모호성이 있다는 점 등을 고려할 때, 역사적 사실의 부인･비방･왜곡･동조･찬양･고무･선전 등의 행위를 모두 처벌 대상으로 하는 것은 엄격한 요건 하에서 인정되는 표현 내용의 규제 범위를 과도하게 넓히는 결과를 낳을 수 있다. 그러므로 이에 대하여는 신중하게 검토가 이루어져야 한다.

Recently, the three bills against history denial were proposed. there is a chance that these bills infringe on freedom of expression in violation of the principle of proportionality. In reality, it is impossible to impose sanctions on individual claims, judgements, and evaluations of all historical facts. In addition, if the denial, slander, distortion, sympathy, praise, inspiration, propaganda, etc. of specific historical facts are punished, the issue of equity might be raised. However, since many people recognize the need to enact a law against history denial, we cannot help but consider the two sides of history denial. As the Special Act of the May 18 Democratization Movement, Etc. stipulates only the spreading of false facts as punishment through the recent revision, the type of punishment needs to be minimized and the level of punishment needs to be adjusted to a similar level. Considering the assessment and judgement of historical events, the process of thinking could vary depending on individual beliefs and opinions, and that criteria for determination of right or wrong regarding historical issues, and the existence of standards are ambiguous, the punishment of all acts such as denial, slander, distortion, sympathy, praise, inspiration, propaganda, etc. could result in excessive regulation. Therefore, it should be reviewed carefully.
