자치경찰제도의 도입에 따른 행정법적 쟁점과 과제

2021년은 전국에 자치경찰제도가 도입된 뜻 깊은 한해이다. 그동안 자치경찰에 대한 논의가 지속되어 왔으나 그 결실을 거두지 못하였던 것을 2021년 7월부터 전국적으로 광역단위에 자치경찰제도가 실시되게 되었다. 자치경찰제도는 지역의 치안을 지역이 스스로 자주적으로 의사결정을 통하여 확보하는 것으로 우리 헌법 상의 지방자치 실현을 구현하게 되었다. 자치경찰은 지역의 치안업무를 수행하여 안전한 지역사회를 확보하는데 있으며, 자치경찰제도에 대한 법적 근거는 국가경찰과 자치경찰의 조직 및 운영에 관한 법률 이 제정되어 이에 근거해 자치경찰제도가 마련되었다. 자치경찰제도는 지역치안 확보를 위해 치안사무를 자치경찰이 수행하는 것으로 이 법률 제4조에서 국가경찰사무와 자치경찰사무를 규정하여 자치경찰이 수행하는 사무를 정하고 있다. 자치경찰이 수행하는 사무는 지역의 생활안전, 교통, 경비, 수사 등에 대한 사무로 그 내용이 행정경찰과 사법경찰을 동시에 포함하고 있다. 자치경찰이 수행할 수 있는 사무는 지역의 치안과 관련되는 모든 사무를 수행하여야 하나, 현행 법률에서는 자치경찰사무를 제한하고 있다. 자치경찰은 지역치안 업무를 수행하여야 하므로 행정경찰이나 사법경찰이나 불문하고 모든 사무를 수행하여야 하나 수사사무는 예외적으로 일부만 자치경찰사무로 두고 있다. 따라서 본 연구는 자치경찰에 부여된 사무범위와 위임입법에 대한 한계점을 행정법적 측면에서 이를 검토하여 개선방안을 제시하였다.

The self-governing police perform local security affairs to secure a safe community, and the legal basis for the self-governing police system was enacted in the ｢Act on the Organization and Operation of the National Police and Self-Governing Police｣, and based on this, the self-governing police system was established. Prepared. In the autonomous police system, the self-governing police conduct public security affairs in order to secure regional security. Article 4 of this Act stipulates the affairs of the state police and the self-governing police, and stipulates the duties performed by the self-governing police. The affairs performed by the self-governing police are affairs related to local life safety, traffic, security, investigation, etc., and the contents include administrative and judicial police at the same time. Offices that can be performed by the autonomous police must perform all affairs related to local security, but the current law restricts the work of the autonomous police. Autonomous police are required to perform local security affairs, so they must perform all affairs regardless of whether they are administrative or judicial police. Therefore, in this study, the scope of work and the limitations of the entrusted legislation given to the autonomous police were reviewed in terms of administrative law, and improved measures were suggested.
