최근 경찰은 네이버의 스마트폰 통역 애플리케이션에 치안 현장에서 자주 쓰이는 내용을 모아 적용하는 경찰 회화 기능을 추가하고, 그 통역기능을 현장 경찰관이 외국인 피의자 인권보호를 위해 사용한다는 방침을 밝힌 바 있다. 이와 관련하여 2018년 경찰의 구글번역 애플리케이션 활용 압수수색에 대한 미국 연방법원 판결례는 인공지능기술 기반 프로그램의 기술적 측면과 법적 측면을 아우르는 신중한 검토 필요성을 시사한다. 인공지능기반 통·번역 어플리케이션의 형사절차상 활용과 관련된 문제의 핵심은 구글번역기와 같은 인공지능기술의 기능적 효과성보다는, 첨단기술기법 수용의 정당성이다. 즉 첨단기술을 활용한 실체적 진실발견과 국민인권보장의 가치실현의 정책목표와 우리 헌법과 형사소송법이 보장하려는 적법절차는 개발발전과정에 있는 기술에 대한 과학적 검증과 실무활용에 대한 법적 검토를 충분히 거친 후에야 실현을 기대할 수 있는 것이다. 그런데 현실적으로 과학적 검증과 법적 검토의 신중함은 국민인권이나 편익 또는 민관협력이라는 명분과 첨단과학기술이 주는 아우라 때문에 뒤로 밀려나기 쉽다는 점에 유의해야 한다. 마땅한 신중함을 견지하려면 인공지능으로 대표되는 첨단과학기술의 형사사법적 활용에 대한 원칙의 정립과 정책도입단계에서의 검토와 정책투입활용단계에서의 검증이 체계화되어야 한다. 뿐만 아니라 민간이 개발한 인공지능기반 애플리케이션을 형사사법기관이 활용하는 문제도 향후 인공지능기반 형사정책도구의 도입활용여부와 관련해서 검토가 필요하다. 기업이 주도하는 인공지능기술의 공적 사용, 특히 형사사법에서의 사용에 있어서 합법성과 공정성의 문제, 민간부문과 협력의 명분과 실용의 긍정적 측면에도 불구하고 일정한 공적 통제 가능성이 확보될 수 있을지의 문제 역시 신중한 검토를 필요로 할 것이다.

Recently, Korean police has introduced smartpone-based interpretation application for the protection of foreign victims and the rights of suspects. At this point, it is worth studying the 2018 case of US Federal District Court of Kansas. The Kansas court found the Google Translate’s “literal but nonsensical” interpretations changed the meaning of the officer’s questions, and as a result Cruz-Zamora’s consent to the search couldn’t really have been knowing. Professional interpreters testified that Google Translate offers only “literal word-for-word translations” and cannot take context into consideration. The court ruled that while it might be reasonable for an officer to use Google Translate to gather basic information such as the defendant’s name or where the defendant was traveling, the court does not believe it is reasonable to rely on the service to obtain consent to an otherwise illegal search. The decision is especially notable because it comes at a time when courts around the world are increasingly considering relying on machine translation during legal proceedings. For introducing AI-technology based policy and tools in the criminal process, especially for promoting due process principles and the protection of suspect s rights, the criminal justice system shoud take both the necessity and legitimacy of such policy and tools into account.
