공직자의 부패방지를 위한 이해충돌방지법의 실효성 확보방안

우리나라의 부패인식지수는 과거에 비해 순위가 계속 오르고 있으나 우리나라의 경제규모가 세계 10위권이며 그동안 정부가 추진해 온 반부패 정책에 비해 매우 저조한 수준이다 이는 정부의 지속적인 반부패 노력에도 불구하고 그 실효성에 의문이 제기되는 부분이다. 이해충돌방지법의 제정은 청탁금지법 제정 당시 제외되었던 이해충돌 부분을 입법함으로써 실효성 확보하고자 하였다. 이 법의 시행은 아직 1년 정도의 시간이 남아있기 때문에 법률의 시행령과 시행규칙이 법률의 목적에 맞게 제정되어야 할 것이다. 또한 법령의 미비점이나 개정사항은 개정안을 통해 개선해 나가야 할 것이다. 이해충돌에 대해 이해 당사자의 본인이 신고하는 것도 중요하나 내부 고발자 보상강화가 필요하다고 본다. 위반사항의 경우 내부에서 더 잘 알 수 있기 때문에 내부감시가 잘 이루어질 수 있도록 해야 하며, 이 경우 내부고발자의 보호와 보상강화가 필요하다. 또한 공직자의 청렴 윤리의식을 높일 수 있는 교육과 더불어 지속적인 외부감사를 강화해야 할 것이다.

With the enactment of the Conflict of Interest Act, it was possible to secure more realistic effectiveness in preventing corruption by enacting the conflict of interest section, which was missing from the legislation at the time of enactment of the Anti-Graft Act. The problem is that the anti-corruption behavior of public officials should be prevented through amendments to various problems that appear after implementation and the anti-corruption behavior of public officials should be blocked in advance by strengthening the internal system. In other words, in the event of a conflict of interest between public officials, etc., it is necessary to prevent public officials from pursuing their private interests using official secrets through prior reporting, evasion of duties, and strong punishment. It is important for interested parties to report conflicts of interest themselves, but I believe that it is necessary to strengthen compensation for whistleblowers. In the case of violations, internal monitoring should be conducted well, since the insider can know better. In addition, continuous external audits should be strengthened along with education to raise public officials integrity and ethical awareness.
