농업용저수지의 활용 다각화와 분법화 방안 연구

A study on the Separative Law and Diversification of the Use of Agricultural Reservoirs

자연환경의 자산 보호는 청정한 환경생태 선진국으로 진입해 가기 위한 필수 과제이다. 농산물 등 먹거리 안전 문제 또한 사회적으로 매우 엄중하게 강조되고 있다. 이에 따라 농산물 생산의 가장 핵심인 농업용수와 그 근거지인 농업용저수지를 어떻게 환경생태적이고 안전하게 관리해 갈 것인가가 정부 차원에서 중대한 화두로 부각되고 있다. 한편 유휴 농업용저수지의 자원화를 위한 열망 또한 높아지고 있다. 그동안의 농업용저수지 정책은 오염 방지 등 수질 관리 강화, 수생태계 보호, 농업용저수지에 연접된 일정 구역 내(內) 행위 규제 중심으로 진행되어 왔으나, 농업용저수지의 지속가능하고 미래지향적인 활용을 위해서는, 저수지와 주변 일대의 친환경적 활용, 주변 지역 주민에 대한 지원 방안 마련 그리고 저수지 활용의 다각화라는 여러 관점에서 법제 정비를 기해야 할 시점에 왔다. 그리고 2018년부터 ｢물관리기본법｣이 시행되고 국가수자원관리가 환경부로 일원화되면서 물관리의 일원화, 통합물관리체계가 구축되어가고 있다. 따라서 농업용저수지에 관한 법체계도 ｢물관리기본법｣과 조화롭게 정비되어야 하며, 나아가 농업용저수지의 활용도 다각화하여 용수활용과 수질관리 뿐만 아니라, 농촌경제의 활성화와 농민의 삶의 질을 제고하는데 기여하여야 할 것이다. 이러한 목적 하에 농업용저수지의 보존과 활용을 촉진할 수 있는 개별법 제정 여지를 법정책학적 관점에서 ‘시론적으로’ 구상해 보고자, 먼저, 농업용저수지를 관리하고 있는 관련 법률들을 검토하기 위하여 농업관련 법률 체계를 일별하고 농업용저수지 관련 법체계를 검토하였으며, 농업용저수지 관리 법체계의 특징을 살펴보았다(Ⅱ). 그리고 농업용저수지의 활용 다각화와 분법화를 위하여, 통합물관리체계와 농업용저수지 관리의 상호관계를 검토하고, 다각화방안과 분법화의 필요성을 분석하였으며, 가칭 ｢농저수지친환경자원화법｣의 입법 방향을 제시하였다(Ⅲ).

How to manage agricultural reservoirs in an environment-friendly and safe manner is emerging as a major issue at the government level. In the past, agricultural reservoir policies have focused on strengthening water quality management, protecting aquatic ecosystems, and regulating behaviors in certain areas connected to agricultural reservoirs. However, for the sustainable and future-oriented use of agricultural reservoirs, the legal system for diversifying the use of agricultural reservoirs should be improved. And as ｢Framework Act On Water Management｣ was implemented from 2018 and the national water resource management was unified with the Ministry of Environment, the unification of water management and an integrated water management system are being established. Therefore, the legal system on agricultural reservoirs should be harmonized with the ｢Framework Act On Water Management｣, and furthermore, by diversifying the use of agricultural reservoirs, it should contribute to not only water use and water quality management, but also to vitalization of the rural economy and improving the quality of life of farmers. For this purpose, the scope for enactment of seperative laws that can promote the conservation and utilization of agricultural reservoirs has been ‘introductorily’ conceived from a legal and policy perspective. First of all, in order to review the relevant laws governing agricultural reservoirs, the agricultural legal system was reviewed, the agricultural reservoir-related legal system was reviewed, and the characteristics of the agricultural reservoir management legal system were examined(II). In order to diversify the use of agricultural reservoirs and make them legalized, the interrelationship between the integrated water management system and agricultural reservoir management was reviewed, and the need for diversification and divisionalization was analyzed. And the legislative direction of the tentative name ｢Act on Agricultural Reservoir Eco-friendly Resources｣ was suggested(Ⅲ).
