회복적 사법에서 공동체의 의미에 관한 소고

A study on the Role of Community in Restorative Justice: About Korean Restorative Justice based on Confucian Thinking

회복적 사법의 지지자들은 갈등이 존재하는 모든 사회에 회복적 정의가 존재하는 것이며, 각각의 공동체들은 갈등으로 인한 다양한 문제해결과 문화적 배경을 가지고 있다고 주장한다. 이러한 주장은 이미 여러 학문영역의 연구에서 확인해 왔다. 이를 근거로 회복적 사법과 동양적 사고의 근본 철학으로 들 수 있는 유교적 사고를 기반으로 갈등 해결 방식을 비교하고 양자의 근본적 사고의 유사점을 찾고, 또 회복에 대한 장애를 가져오는 요인을 조사하여 이를 제거하거나 함양하기 위한 방안을 제안하고자 하였다. 회복적 사법 프로그램의 성공적 운용에서 공동체의 역할은 매우 중요하게 강조된다. 그럼에도 불구하고 사건의 당사자로 구체화 되는 가해자와 피해자에 비해 공동체는 추상성을 갖게 된다. 또한 공동체가 갖는 특징은 그 사회의 문화와 구성원들의 관계, 관습 등이 중요하게 작용한다. 우리사회의 문화적 배경을 중심으로 한국 공동체의 주요가치관을 파악하고 회복적 사법에서 공동체의 역할 특히 우리사회에서 대응한 전략으로서 공동체의 역할에 대하여 연구하고자 하였다. 즉 공동체가 문제해결의 중요한 역할을 담당하던 관계지향적 우리 공동체 문화에서 출발하여 회복적 사법에서의 공동체의 의미와 역할에 대하여 좀 더 구체적인 그림을 제안해 본다.

This course compares conflict resolution methods based on Confucian thinking with the fundamental philosophy of restorative justice and Eastern thinking, finds similarities between the two fundamental thinking, and seeks ways to eliminate or cultivate obstacles to recovery caused by cultural differences. Restorative justice expresses its position and needs to recover from damage. However, oriental thinking has been taboo in the expression of personal needs and adherence to position. This collectivist Eastern thinking has a great influence on resolving conflicts among internal members. On the other hand, discussions of restorative justice have already been developed in our culture, where the community has an important meaning as an agricultural society, and by confirming this, a study that introduces theoretical grounds and footholds to the criminal policy tendency to introduce restorative justice into the criminal justice paradigm.
