교원노동조합법의 법제상 문제점에 대한 연구

Treaties on some Weaknesses of Teacher Union Law - Collective in Education: Background and Performance -

이 연구의 주된 내용은 1999년 1월 29일 제정된 교원의 노동조합 설립 및 운영 등에 관한 법률에 의해 교원노동조합과 단체교섭제도가 도입된 배경과 이후의 성과를 검토하여 그 드러난 문제점들을 살펴보고 현행 법률과 그 시행령에 내재되어 있는 법제상의 문제점에 기인한 점은 없는지를 찾아보고자 하는 것이다. 더 나아가 산업경제 시기의 유산인 현행의 교원노동조합체제가 과연 21세기에 부합하는 교육발전을 위한 교직단체의 모습으로 근본적으로 얼마나 타당성이 있는지를 분석할 것이다. 연구 결과는 향후 교원의 노동조합 설립 및 운영 등에 관한 법률 및 동시행령 개정을 위한 입법 정책 자료로 활용될 수 있을 것이다.

This paper deals the collective bargaining in education according the line of the political background and the performance. It also investigates on the weaknesses of current Teacher Union Law(TUL) as legislated on January 1. 1999. The provisions of TUL as well as the Decree on TUL(DTUL) has some structural problems incurring constraints on the practice of the collective negotiating process in education. The teacher union Korea depends too much on the model of industrial labor relation. Investigator tried to expose out the limit of the current system in the newly emerging educational practice of 21th century. The result of the study would contribute to the necessary consolidation of the TUL and DTUL provisions.
