수사준칙의 구체화·체계화에 관한 연구

A Study on Reification and Codification of Criminal Investigation Rules in 2020: In Connection with an Example of ｢Video Recording Rules｣

본 연구는 제정 수사준칙 내에 규율상의 사각지대가 많다는 점에 착안하여, 수사준칙의 구체화·체계화 필요성 논증한 후, 그 일례로 가칭 「영상녹화 준칙」 제정례를제안하였다. Ⅱ에서는 수사준칙의 규율 부재 또는 미흡에 따른 하위 규범의 대체규율 현상, 수사절차상 주요 쟁점에 대한 기관 규범의 규율상 차이, 복수의 수사준칙 제정의 필요성 등을 확인하였다. Ⅲ에서는 검·경의 영상녹화 업무처리 지침 간에 존재하는 다수의 차이점, 「영상녹화 준칙」 제정에 있어 두 지침의 의의와 제약점 등을 확인하였다. Ⅳ에서는 이상의 고찰을 종합하여, 「영상녹화 준칙」 제정례 제안의 기준및 구체적 조문화[案]을 제안하였다.

Based on a critical mind about blind spots in the Criminal Investigation Rules in 2020, this study demonstrated the necessity of reification and codification of the rules, and suggested an example of 「Video Recording Rules」. In chapter Ⅱ, phenomena of remplacement of ruling by subordinate statutes which are due to blind spots in the superior statutes, differences in subordinate statutes ruling on important investigative precesses, necessity of pluralization of the Criminal Investigation Rules were identified. In chapter Ⅲ, remarkable differences between agencies’ subordinate statutes on video recording, the meanings and limintations of the statutes were identified. In chapter Ⅳ, an example of 「Video Recording Rules」 was suggested with some criteria of the example.
