수사상 경찰의 불송치 결정에 대한 절차적 통제방안 검토

수사권조정은 검찰개혁의 일환으로 검찰에 집중된 권한을 경찰에 분산하여 상호견제와 균형의 원리가 작동하도록 한다는 취지에서 실시되었다. 경찰은 수사권조정에 따라 수사개시 및 진행권에 더하여 수사종결권이라 할 수 있는 불송치 결정권을부여받았다. 경찰의 권한이 강화된 만큼 그에 대한 통제방안의 설정도 매우 중요한과제라고 할 것이다. 이 연구는 경찰에 부여된 권한 중에서도 특히 불송치 결정에 대한 통제방안이 적정하게 설계된 것인지에 대하여 검토하였다. 경찰의 불송치 결정에 대한 통제방안으로 고소인 등의 이의신청권, 검사의 90일간 사건기록 등 검토권 및 재수사요청권이 규정되었다. 먼저 이의신청권과 관련, 이의신청이 있기만 하면 일률적으로 검사에 송치토록 한 것은 합리적인 조치라 할 수없고, 이의신청 기한의 미설정, 이의신청 사건에 대한 수사주체의 혼선 등을 문제점으로 지적하였다. 다음으로 검사에 사건기록 등 일체를 송부하여 90일간 검토하도록 한 것은 형사절차상 효율성의 상실, 경찰의 내․외부 자정시스템의 형해와와 수사책임을 불명하게 한다는 문제점과 함께 검찰수사에 대한 통제와도 균형성을 잃고 있음을 지적하였다. 결론적으로 중장기적인 관점에서 법 개정을 제안하였고, 단기적인차원에서 검․경이 실무협의를 통해 취할 수 있는 방안들을 제시하였다.

Adjustment of investigative power was carried out as part of the prosecution reform. The goal was to distribute the authority concentrated on the prosecution to the police so that the principle of mutual checks and balance could work. In addition to the right to initiate the investigation and the right to proceed with the investigation, the police were granted the power of non-transmission decisions, which is the right to terminate the investigation. As the police’s authority has been strengthened, setting up control measures for it is also a very important task. This study examined whether the control plan for non-transmission decisions was appropriately designed among the powers granted to the police. As a control measure for the police’s non-transmission decision, the right to file an objection by the complainant, the prosecutor’s right to review the case records for 90 days, and the right to request a re-investigation were stipulated. Regarding the right to file an objection, it cannot be said that it is a reasonable measure to send it to the prosecution uniformly as long as there is an objection, and it pointed out that the deadline for objection was not set and confusion of the investigator in the objection case.
