Trustworthy Investigatory Compentecy and the Police Reform

본 논문은 경찰 수사역량 강화 과제를 권력기관개혁과 형사사법개혁 맥락에서 살펴보고, 현재까지 수사구조개혁 내지 수사권개혁이 진행되는 과정에서 경찰개혁위원회의 개혁기획과 경찰의 실천성과 중 경찰 수사역량과 관련된 과제와 정책을 살펴봄으로써 경찰 수사역량 개선강화의 방향성과 과제내용을 전망해 본다. 수사구조개혁은 국가수사구조와 역량의 핵심에 경찰과 경찰수사를 위치지우면서경찰 수사역량 개선강화에 대한 요청이었음에도 불구하고 이에 대한 정책적 기획이부족했던 점은 아쉽고, 또한 그런만큼 향후 형사사법개혁의 지속을 위해서 가장 중요한 정책과제로서 추진되어야 할 것이다. 경찰 수사역량은 수사구조개혁 추진의 전제이기도 하거니와, 그 진전에 따른 성과의 의미도 있기 때문이다. 수사구조개혁에따른 경찰의 수사권한은 개선강화된 수사역량으로 뒷받침 되어야 비로소 실현될 것이며, 그 수사역량은 신뢰가능한 역량이어야 한다. 무엇보다도 국민의 신뢰와 지지없이는 개혁이 지속될 수 없고 개혁성과도 바라기 어렵다. 이제 권력기관개혁이라는국정과제로 출발한 수사구조개혁 정책의 향후 성패는 경찰 수사역량에 달려있다. 경찰 수사역량의 개선강화는 단순히 기관조직이나 인력의 확대가 아니라, 그토록 기관마다 앞다투어 위하고자 했던 ‘국민’의 신뢰를 강화하는 문제다. 수사구조개혁이라는 시대적 맥락을 고려해 보건대, 경찰 수사역량의 가치지향적목표는 신뢰가능한 수사역량(Trustworthy investigatory Competency)이다. 이를구성하는 표지는 공적 책임성(accountability), 전문성(technical competence), 법적 사고(legal mindset)로 제시할 수 있다.

This essay studies the issues of police investigatory competency in the era of investigatory powers reform and criminal justice reform perfomed through current government’s national reform agenda. How to promote police investigatory competency in the context of the police reform and public confidence towards the recent criminal justice reform? Police powers to criminal investigation has been placed at the core of the national investigatory competency by the implemenation of so-called investigatory structure reform or investigatory powers reform. However, some value-oriented initiative to enhance police investigatory competency may not have get attention while such reforms have focused on the policy matter of organizational structures and powers among criminal justice agencies. What should be matter is justiable and effective police investigatory competency which should be evaluated from the point of public confidence on the effect of police reform, which has proivided more powers and obligations of the police to secure people’s safety and liberty in everyday life. Without public confidence, any reform or any policy of promoting police competency would not be successful. Thus, considering the idea of investigatory powers reform, and the recommedation of the police reform commission, promotion policy of police investigatory competency should be value-oriented, that is, trustworthy investigatory competency. This can be measured by the values of accountability, technical competence, legal mindset of the poice officers in criminal investigation.
