전통법문화에서 법의 문자어원상 개념과 규범 비유

The Etymological Conceptions of Law & Some Metaphors of Norms in East Asian Traditional Legal Culture

전통법의 궁극 이상은 ‘情’･‘理’･‘法’의 삼위일체 통일조화라 할 수 있다. 허나 일반으로 ‘法은 곧 刑’이라는 부정적 법의식감정 때문에 전통법문화에 대한 선입견이 왜곡되어 왔다. 본고는 전통법문화의 본래 진면목을 밝히기 위하여, 情･理 이념의 현실적 토대로서 다양한 法의 개념범주를 검토한다. 전통법의 범주를 설정하는 기초 작업으로서, 우선 법과 직접 관련된 개념들의 문자어원상 함의를 중심으로 법의 본질속성 및 범위를 고찰한다. 구체로 전통법의 주요 핵심 호칭인 法･刑･律의 문자어원상 개념, 법과 형의 개념 관계, 규범과 도량형을 비롯한 각종 법규범적 비유의 함의를 다각도로 두루 살펴보면서, 거기에 담긴 철학사상적 정신지혜까지 음미해 본다. 우리 전통법문화가 근대 서양법에 비해 전근대적이고 봉건적인 낙후한 구습이라는 막연한 편견과 선입관을 불식하고, 전통의 긍정적 정신지혜를 밝혀 온고지신으로 21세기 최첨단 현대문명에 걸맞은 새로운 법문화 창달에 조금이나마 유의미한 참고가 되길 바란다.

The ultimate idea in East Asian Traditional Legal Culture may be summarized as forming a trinity of traditional concepts of qing(情: subjective sentiment or objective situation)･li(理: reason)･fa(法: law). However generally speaking, the people have wide preconceived idea on East Asian Traditional Legal Culture because of negative consciousness that ‘law is punishment.’ This paper will study the conceptions of various traditional categories of law as the bases of traditional idea of qing(情: subjective sentiment or objective situation)･li(理: reason)･fa(法: law), in order to make true self of Traditional Legal Culture clear. Main contents of this article as follows. The Etymological Conceptions of fa(法←灋: Law), Xing(㓝: punishment) and Lü(律) are researched widely & deeply. Some Metaphors of Norms & Weights and Measures also will be investigated in East Asian Traditional Legal Culture & thoughts at large & in detail. We also may be blessed with philosophical wisdoms of various schools of thought in ancient China in addition. The author hope that widely & deeply distorted & prejudiced view on Asian traditional legal culture may be cast away. The writer also hope that this work may be of small help to enhancement of positive spirits & wisdoms of Asian tradition, and also be some reference to dialectical synthesis of Eastern tradition & Western modernization.
