지방자치단체 평생학습 자치법규의 구조구성체제와 특성분석

A Study on the Structural Composition System and Characteristics of Local Governments Autonomy Laws for Lifelong Learning

본 연구는 지방자치단체 평생학습 자치법규의 형성 추이, 현황, 구조, 구성체제에 대해 CDA 연구방법의 귀납적 접근 하에 개방코딩, 축코딩, 선택코딩을 통해서 형성한 분석적 생성개념을 토대로 관련 특성을 탐구하는 데 목적이 있었다. 주요 연구결과는 첫째, 평생학습 자치법규의 전국적 모집단 현상을 밝혔다. 둘째, 평생학습 자치법규의 위계적·다원적 법체제 형성의 확산추세를 확인하였다. 셋째, 지방자치단체 수준별 평생학습 자치법규의 제정 주체에 초점을 맞추어 평생학습 광역자치법규와 평생학습 기초자치법규로 분류하였다. 넷째, 평생학습 자치법규를 성격별로 기본적 자치법규와 목적성 자치법규로 유형화하였다. 다섯째, 평생학습 자치법규의 실태를 법체제의 구조형식, 구조영역, 구성항목 차원에서 분석하여 특성을 도출하였다. 여섯째, 평생학습 자치법규의 구성항목을 분석하여 그 특성을 탐구하였다. 이상의 결과는 지방자치단체 수준에서 평생교육과 관련한 다양한 법규와 법체제의 실태를 실증적으로 조망할 수 있는 의미 있는 개념들을 생성하고, 평생학습 자치법규를 새롭게 제정 및 개정하는 과정에서 실질적으로 활용 가능한 법체제 구조와 구성의 원리 및 항목을 결정하는 지침으로 활용될 수 있을 것으로 기대된다.

The purpose of this study is to investigate the related characteristics based on the analytically generated concepts formed through CDA method on the enacted trends, the current status, the structural compositions systems of the local government’ autonomy laws for lifelong learning. The results are as follows: First, the national phenomenon of the local government’ autonomy laws for lifelong learning was revealed. Second, the trend of spreading the hierarchical and pluralistic legal system was confirmed. Third, the study classified the lifelong learning metropolitan local-governing law and the lifelong learning basic local-governing law focusing on the subject of the enactment by local government level. Fourth, the lifelong learning local-governing laws were classified into the basic laws and the purposeful laws by character. Fifth, the actual condition of the lifelong learning local-governing law was analyzed in terms of the structural form, structural area, and compositional items of the legal system, and the characteristics were derived. Sixth, the characteristics of the lifelong learning local-governing laws were investigated by analyzing the components. The results are expected to be used as a guideline to determine the principles and items of legal structure and composition that can be practically utilized in the process of creating meaningful concepts that can empirically look at various laws and legal systems related to lifelong education at the local government level and newly enacting and revising lifelong learning local-governing laws.
